The Defendant Eddie Ladell Cunningham appeared before Judge Anita Harold Ashley to enter a plea of guilty to the charge of “Conspiracy to Violate 60A” of the West Virginia State Code. The charge can carry as little as 2 years but as much as 15 years of incarceration if convicted. Mr. Cunningham entered his plea following judge Ashley’s advice that it is a “Big deal, to enter a plea of guilty to a felony charged. There is no guarantee that you will not be given the maximum ammount of time allowed. In spite of that, Mr. Cunningham waived his right to a trial.
Cuningham had recidivous charges (prior felonies that could have been considered into his sentencing) but would not be. He is currently servicing felony time in Wood county and has requested that his sentence run concurrent (along side) the current jail time, allowing less time to be served rather than consecutive which would start when his Wood county sentence ends.
Sentencing will take place following a presentence investigation conducted by Alicia Lawson, Calhoun Probation officer. At which time Cunningham will return on June 8th, 2022 at 9 a.m. for sentencing.
