Calhoun BOE Levy to be Voted on November 5th, 2024

ORDER OF THE BOARD OF EDUCATION OF THE COUNTY OF CALHOUN DIRECTING AN ELECTION TO BE HELD TO AUTHORIZE CONTINUATION OF ADDITIONAL TAX LEVIES FOR THE FISCAL YEARS BEGINNING JULY 1, 2025, JULY 1, 2026, JULY 1, 2027, JULY 1, 2028, AND JULY 1, 2029

That at a statutory meeting of the Board of Education of the County of CALHOUN, State of West Virginia, held on August 23, 2024, as provided by law, the following Order was made and entered for record, to-wit:

BE IT ORDERED BY THE BOARD OF EDUCATION OF THE COUNTY OF CALHOUN:

The Board of Education of the County of Calhoun being of the opinion that the Maximum Levies for current expenses authorized by Article 8, Chapter 11 of the Code of West Virginia, as amended, will not provide sufficient funds for the payment of current expenses of the Board of Education, including expenditures for the purpose or purposes hereinafter set forth, and that an election should be held to increase such levies under the provisions of Section 16, Article 8, Chapter 11 of the Code, as amended, it is hereby ordered:

1. That the purposes for which additional funds are needed, together with the approximate amount for each purpose, are as follows:

A. General Maintenance, Improvements, and Equipment: Including, but not limited to, playground equipment at Calhoun Middle High School; improvement and maintenance of county-wide athletic facilities; improvements required by local, state, and federal agencies to ensure safe and efficient operation of facilities; custodial and maintenance supplies and equipment; and other related expenses.

APPROXIMATE ANNUAL AMOUNT OF:

$208,667.00

B. Safety and Security: Including but not limited to School Nurse, Preventative Resource Officer and Technology Systems Specialist, with benefits.

APPROXIMATE ANNUAL AMOUNT OF:

$200,000.00

C. Curriculum and Instruction: Provide funding to include staffing for, but not limited to, additional curriculum and instructionally related programs for summer school.

APPROXIMATE ANNUAL AMOUNT OF:

$170,000.00

D. Provide for the support of extra-curricular (including but not limited to athletic teams, band, music activities, theater activities, academic competitions, and after school programs), curricular and/or academic (including but not limited to field trips, academic competitions) transportation for students in grades Pre-K – 12.

APPROXIMATE ANNUAL AMOUNT OF:

$36,000.00

E. Supplement the salaries of all professional and service personnel salaries in the amount of $750.00 each.

APPROXIMATE ANNUAL AMOUNT OF:

$161,000.00 

F. Provide Art Cart for students at Pleasant Hill and Arnoldsburg Elementary.
APPROXIMATE ANNUAL AMOUNT OF:

$75,000.00

Total:

$850,667.00

The amounts set forth above are the average annual amounts for each purpose. The actual amounts for each purpose will likely vary from one fiscal year to the next. If any item in the above-stated purposes is declared unconstitutional or invalid due to judicial or legislative action, then any affected funds will be distributed among the remaining constitutional and valid itemized purposes.

2. The total amount necessary to carry out the above purposes over five fiscal years, after making reasonable allowances for uncollected taxes and shrinkage, is approximately $4,253,335.00, or the average sum of $850,667.00 annually. The actual amounts budgeted, as well as the amounts spent, for each purpose and in aggregate, likely will vary from one fiscal year to the next depending on the realized tax collections and the needs of the Calhoun County School District, as determined by the Board with respect to each fiscal year. If the amounts budgeted by the Board for a specific purpose or purposes for a fiscal year are not able to be spent entirely in such fiscal year, then the unspent amount shall be carried over and spent on such specific purpose or purposes in subsequent fiscal years.

3. That the separate and aggregate assessed valuation of each class of taxable property within the County of Calhoun is as follows:

Class I $0.00

Class II $107,660,362

Class III $395,969,846

Class IV $10,011,688

Aggregate $513,641,896

4. That the proposed additional rate of levy in cents per one hundred dollars of assessed valuations of each class of property is as follows:

Class I – 4.97 cents

Class II – 9.94 cents

Class III – 19.88 cents

Class IV – 19.88 cents

5. That the proposed years to which the additional levy shall apply are the fiscal years beginning July 1, 2025; July 1, 2026; July 1, 2027; July 1, 2028; and July 1, 2029.

6. That the Board of Education of the County of Calhoun is hereby authorized, and empowered to expend during the term of this levy, the surplus, if any, accruing in excess of the amounts needed for any of the above-stated purposes, plus excess collections, due to increased assessed valuations for the enrichment, supplementation,

operation, and improvement of educational services, and/or facilities in the public schools of the County of Calhoun.

7. That the Calhoun County Board of Education will not issue bonds against this levy.

8. That should any item in the aforementioned purposes be declared unconstitutional or invalid due to judicial or legislative action, affected funds will be distributed among remaining unaffected items.

9. That in the event other funds or additional funds are obtained by grant or allocation from state, federal, local, or any other sources, then the Board shall be empowered to expend at the end of each fiscal year, during the term on the levies, the surplus (if any) in excess of the amount needed for any of the above-stated purposes for the enrichment, supplementation and advancement of all educational programs in the Calhoun County School District, and other purposes pertinent to the operation of Calhoun Schools, in the discretion of the Board. Such additional or surplus funds may be used in place of the funds described above and/or in addition to the amount obtained from this levy.

10. That the Board of Education of the County of Calhoun may, if the Board deems it to be in its best interests, reduce these said rates in any given year or years during the term of this levy after determining the sufficiency of funds for school purposes for the next ensuing taxable year.

11. That the question of continuing such additional levy shall be submitted to a vote at the General Election, to be held on the 5th day of November, 2024.

12. That notice calling such election shall be given by the publication of this Order once each week for two successive weeks before said election in two newspapers of opposite politics and of general circulation in the Calhoun County School District. All the provisions of the laws concerning general elections shall apply as far as they are practicable, with the exception of the provisions contained in Section 17, Article 8, Chapter 11 of the West Virginia Code, as last amended.

13. That the registration of voters, and use of registration books shall be governed by the permanent registration laws of the State of West Virginia; and the Board of Education of the County of Calhoun does hereby adopt the registrations lists of and for said Calhoun County, as amended and corrected, according to law, as the official registration lists of said Calhoun County School District for such Primary Election.

14. The Secretary of the Board is hereby authorized, and directed to attend to the publication of this Order as herein set forth, and do any and all things necessary to present the questions proposed by this Order to the voters in the Calhoun County School District at said General Election.

15. That the ballot to be used at such election shall be in form as follows:

Special election to authorize the continuation of additional levies for the fiscal years beginning July 1, 2025, July 1, 2026, July 1, 2027, July 1, 2028, and July 1, 2029, and for the purpose of maintaining and improving the instructional programs and the operation of school services in Calhoun County including, but not limited to:

A. General Maintenance, Improvements, and Equipment: Including, but not limited to, playground equipment at Calhoun Middle High School; improvement and maintenance of county-wide athletic facilities; improvements required by local, state, and federal agencies to ensure safe and efficient operation of facilities: custodial and maintenance supplies and equipment; and other related expenses.

APPROXIMATE ANNUAL AMOUNT OF: $208,667.00

C. Curriculum and Instruction: Provide funding to include staffing for, but not limited to, additional curriculum and instructionally related programs for summer school.

D. Provide for the support of extra-curricular (including but not limited to athletic teams, band, music activities, theater activities, academic competitions, and after school programs), curricular and/or academic (including but not limited to field trips, academic competitions) transportation for students in grades Pre-K – 12.

APPROXIMATE ANNUAL AMOUNT OF:$36,000.00

E. Supplement the salaries of all professional and service personnel salaries in the amount of $750.00 each.

APPROXIMATE ANNUAL AMOUNT OF: $161,000.00

F. Provide Art Cart for students at Pleasant Hill and Arnoldsburg Elementary.

APPROXIMATE ANNUAL AMOUNT OF: $75,000.00

according to the order of the Board of Education of the County of Calhoun entered on the ___ day of ____________________, 2024.

TOTAL APPROXIMATE NET ANNUAL AMOUNT NEEDED AFTER DUE ALLOWANCES FOR DELINQUENT TAXES, DISCOUNTS, AND EXONERATIONS: $850,667.00.

Should any item in the aforementioned purposes be declared unconstitutional or invalid due to judicial or legislative action, affected funds will be distributed among remaining unaffected items.

The Board of Education of the County of Calhoun may, if the Board deems it to be in its best interests, reduce these said rates in any given year or years during the term of this levy after determining the sufficiency of funds for school purposes for the next ensuing taxable year. The Board of Education of the County of Calhoun is hereby authorized and empowered to expend, during the term of this levy, the surplus, if any, accruing in excess of the amounts needed for any of the above stated purposes, plus excess collections due to increased assessed valuations to enrich, supplement, and improve the educational services and/or facilities in the public schools of the County of Calhoun. In the event that the amount collected is less than the amounts noted for the aforementioned purposes, the Board of Education expenditures may be reduced in any particular category or categories, as may be required.

In the event the Board of Education of the County of Calhoun shall obtain additional money, by grant or otherwise, from the state or federal government or from any agency of either, or from any other source, for the purposes aforesaid, such additional money may be used either in substitution for, or in addition to, the sums obtained from such additional levies as said Board of Education of the County of Calhoun may from time to time determine.

The approval on November 5, 2024, of an additional levy for each $100.00 assessed valuation of property shall be 4.97 cents on Class I property; 9.94 cents on Class II property; 19.88 cents on Class III property; and 19.88 cents on Class IV property.
