Carbaugh Sentenced to Home Confinement in Jackson Circuit Court

On February 11, 2022, the State of West Virginia by Joshua W. Downey, Appointed Special Prosecuting Attorney for Jackson County, West Virginia, and Defendant, Rodney Carbaugh, by counsel Roger Lambert appeared before Judge Lora Dyer to be sentenced in case CC-18-2019-F-55.

The defendant, Rodney Carbaugh made plea of guilty to two 2) counts of the offense of “Sexual Assault in the Third Degree.”

The Court advised the Defendant that he was required to register as a sex offender for life and it was considered and ORDERED by the Court that the defendant, Rodney Carbaugh, be committed to the custody of the Commissioner of the West Virginia Division of Corrections for a term of No Less Than One (1) Year and No More Than Five (5) Years from February 11, 2022 on both counts of “Sexual Assualt in the Third Degree”, to run consecutively. However, following a defense motion, Rodney Carbaugh was permitted to serve the terms of imprisonment in this matter by alternative means (with multiple conditions) of home incarceration to be supervised by the Calhoun County Home Confinement Office.

The defendant was further ordered to pay the costs of that supervision as well as restitution to the victim in the amount of $884.20, and all court costs.
