Clary Charged with Felony Domestic Battery

In a complaint filed in the Magistrate Court of Calhoun County, by Trooper R.L. Santana of the Spencer Detachment, the Trooper stated on Wednesday March 19th, 2025, at approximately 10:45 p.m., he and and Corporal Z.W. Hartley were dispatched by Calhoun County 911 center to a residence specifically located at 1031 Left Rush Run Road Orma,
WV 25268 in reference to a domestic between father and son.
The Troopers were advised the father David Arthur Clary and his son were arguing at which time David Arthur Clary was throwing things around thee kitchen.

Upon arriving on scene, the Troopers as well as Calhoun County Sheriff G. Knight came into contact with the accused sitting down on the couch in the living room. The accused had several knives in his immediate proximity and appeared to be intoxicated due to the smell of alcohol, slurred speech, and bloodshot eyes.

Corporal Z.W. Hartley detained the accused and the parties were separated. Trooper Santana then spoke with the victim who advised that he was lying in bed when he heard some noise in the kitchen. When we went to investigate the noise, he further advised he saw David Arthur Clary throwing things off the kitchen counters. When the Clary was confronted by the victim, the victim stated the accused physically attacked him. The victim stated he was punched by the accused on the back of the head and pushed down behind the recliner in the living room.

Upon the Troopers observing the items thrown on the floor in the kitchen, the torn shirt on the victim, and the swelling on the back of the victim’s head, they determined David Arthur Clary to be the aggressor who was placed under arrest. Upon placing Clary under arrest, he was then transported to the Big Otter Detachment for processing.

Upon processing, it was learned by by Trooper Santana that the accused, David Arthur Clary had two (2) prior domestic battery convictions. The first conviction being on May 17th, 2022, and the second conviction being on August 4th, 2022. Upon processing, the accused was then transported to the Central Regional Jail to await arraignment.

Clary continues to be held at WV Central Regional Jail on a $10,000 bond having been charged with Felony Domestic Battery third offense.
