Lizemore Man Arrested for Attempting to Lure Calhoun Teen

In a complaint filed in the Magistrate office of Lora Davis, Trooper J.D. Richards stated that on or about Sunday, August 27th, 2023 at approximately 1:30 p.m. Trooper Richards was contacted by Calhoun County Dispatch regarding an incident where a female juvenile had been shown genitals of an adult male via a FaceTime video.

The Trooper traveled to the address of the 17 year old juvenile and spoke with her. The victim stated to Trooper Richards that the male had contacted her via facetime earlier on the same date at approximately 8 a.m. The victim also disclosed to the Trooper that the male, Terrence Jason Holey DOB: 05/21/1986 of Lizemore, WV, Clay County, showed his genitals to her. The victim stated that the accused’s genitals were shown out of nowhere shocking the victim and causing her to drop her phone, letting out a scream. The victim stated that this awoke the other residents in the house up. Trooper Richards inquired of the victim if any act like this had happened before to which she replied that the accused had acted “weird” towards her recently.

All acts in this complaint, including the receiving of these messages and facetime occurred in Calhoun County, WV.
With all facts considered, this Trooper requested an arrest warrant for the accused for the charges of soliciting a minor, distribution of obscene material to a minor, and use of obscene matter with intent to seduce minor.

Holley was arrested on April 22, 2024 and taken to the WV Central Regional Jail where he awaits trial on a $100,000 bond.

WV State Code for the aforementioned charges are as follows:

§61-8A-4. Use of obscene matter with intent to seduce minor.
Any adult, having knowledge of the character of the matter, who knows that a person is a minor and distributes, offers to distribute or displays by any means any obscene matter to the minor, and such distribution, offer to distribute, or display is undertaken with the intent or for the purpose of facilitating the sexual seduction or abuse of the minor, is guilty of a felony and, upon conviction thereof, shall be fined not more than twenty-five thousand dollars, or confined in a state correctional facility for not more than five years, or both. For a second and each subsequent commission of such ofense, such person is guilty of afelony and, upon conviction, shall be fined not more than fifty thousand dollars or confined in a state correctional facility for not more than ten years, or both.

§61-8A-2. Distribution and display to minor of obscene matter
(a) Any adult, with knowledge of the character of the matter, who knowingly and intentionally distributes, offers to distribute, or displays to minor any obscene mater, si guilty of a felony and, upon conviction thereof, shall be fined not more than twenty-five thousand dollars, or confined in a state correctional facility for not more than five years, or both.

§61-3C-14b. Soliciting, etc, a Minor via Computer
(a) Any person over the age of eighteen, who knowingly uses a computer to solicit, entice, seduce or lure, or attempt to solicit, entice, seduces or lure a minor, in order to engage in any illegal act proscribed by the provisions of article eight, eight-b, eight-c or eight-d of this chapter, or any felony offense under section four hundred one, article four, chapter sixty-a of this code, is guilty of a felony and upon conviction thereof, shall be fined not more than $5,000 or imprisoned in a state correctional facility not less than two nor more than ten years or both.

The defendant is considered innocent until proven guilty.
