Calhoun Circuit Court had a Long Docket with a Long list of Crimes in Calhoun County

Judge Anita Harold Ashley had a full day of Criminal and Juvenile cases in Calhoun Circuit Court on Thursday, May 12th. Following Grand Jury on Monday, May 3rd, there were several indictments set for arraignment as well as previously scheduled cases.

Travis Sheldon Boggs appeared before Judge Ashley via MS Teams from Central Regional Jail on a Motion to Revoke Probation.

Alicia Lawson, Probation Officer, was the first witness called by Nigel Jeffries, Prosecuting Attorney, having been Boggs’ supervising officer since his placement on probation in 2019. Lawson stated that Boggs failed to be compliant by failing a drug test in April of 2022, failure to pay required fines and costs which originally totaled $6,000, failure to attend required AA and NA meetings as well as testing positive on a drug screen upon commitment into the WV Central Regional Jail on April 27. The substances found in Boggs system were meth amphetamine and amphetamines.

Attorney, Betty Gregory defended Boggs by reporting that he had attended Smart Recovery Meetings via Zoom through Lori Fleagle, DART director. He has also successfully completed the drug treatment program at Recovery Point. Boggs testified that he had attempted to stay current with NA and AA meetings and was willing to return to Recovery Point for further treatment. He currently had $1,000 to pay towards his fines and apologized for the ”hiccup” with substance abuse.

Judge Ashley concluded that Boggs had had multiple opportunities and that he was ”out of excuses.” She sentenced him to complete the 1-5 years of the original sentence and recommended the Residential Substance Abuse Treatment Program for State inmates .

Christopher Mason
Kia Mason

Mother and son, Christopher Daniel Mason and Kia Shavonne Mason were arraigned via MS Teams at WV Central Regional Jail. The two are both incarcerated in the same facility but had likely not seen each other since their arrest. Being arraigned at the same time brought them together in the WVCRJ facility, at which time Kia Mason ask if she could hug her son. It was permitted and the two hugged and enjoyed the reunion. Their reunion was also enjoyed by Court Staff.

The Defense attorneys sought a modification of bond which the State approved at which time the bond was reduced to $25,000 Cash, Surety or Property. Pretrial on the case is set for July 6th at 11:00 a.m. and a Trial date of August 16 for both defendants.

Isaac Charles Grounds was arraigned on the charge of felony fleeing. He entered a not guilty plea and is scheduled for a pretrial on July 6th, 2022 at 11:30 a.m. and for trial on July 19 at 9 a.m. Mr. Grounds is current facing charges in the following counties:

Dylan Paul Little

Dylan Paul Little was arraigned via MS Teams at the WV Central Regional Jail being held on $75,000 bond for Receiving and Transferring Stolen Property. Following a not guilty plea, his pretrial is set for July 21, 2022 at 2:15 p.m. and a trial date for October 4th, 2022 at 9 a.m.

His Co defendant was David Paul Little who is currently released with a $10,000 cash/surety/property bond. He entered a plea of not guilty and is set fro a pretrial on July 21 at 2:15 p.m.

Carrie Lynn Ball appeared before Judge Anita Ashley for final sentencing in case 20-F-3 where she had entered into a High Low agreement facing a felony offense if she failed to complete the agreement. Prosecutor Niles Jeffries informed the Judge that Miss Ball had successfully complete her program without incident and recommend a period of three months probation. Judge Ashley commended her on her success and found her guilty of the reduced misdemeanor offense of Possession of Meth Amphetamines. She then sentenced Miss Ball to one day of probation. When the Judge ask her if she had anything to say her response was ”It wasn’t worth it, and I’m not going back!”

Robert Scott Carpenter appeared before Judge Ashley on an indictment for Wrongful Injury to Timber. Following his not guilty plea, and decision to hire private counsel, Judge Ashley released him on a $10,000 cash/surety/property bond to be paid by Friday, at 3:30 p.m. His pretrial hearing is set for June 9 at 9:45 p.m.

Christopher Mark Sampson appeared before Judge Anita Ashley following his indictment for possession with Intent to deliver Methamphetamine. He entered a plea of not guilty and his attorney Betty Gregory requested a reduction of bond from $50,000 which was denied. His pretrial hearing is scheduled for July 6 at 9:30 a.m. with a trial date of July 19th at 9 a.m.

Danny H. Burrows, facing 3 counts of first degree arson is set for arraignment before Judge Anita Ashley in Spencer, WV via Teams, today at 2:15p.m. His bond has been set at $100,000 Cash/Property/Surety.

Tony McCune was set to appear before Judge Anita Ashley for a pre-trial conference along with Attorney Barbara Shamblin, but neither appeared. A capias for the arrest of Tony McCune was issued as well as an order to show cause for Attorney Shamblin.

Amanda Testerman appeared for arraignment before Judge Anita Ashley on the charge of Grand Larceny. She plead not guilty and was her case was continued until August 3rd at 10:30 a.m. for pretrial and on December 13 at 9 a.m. for trial.

George Nicholas Parsons appeared before Judge Anita Ashley on May 12, 2022 via teams from the Stevens Correctional Center in McDowell County. Bond was set in the amount of $50,000 cash/surety/property. The state currently believes Mr. Parsons is a flight risk because he is facing life in prison if convicted of the current charges of Fleeing DUI; Fleeing with Reckless Indifference; And Driving on a Suspended License for DUI x 2.

Kimberly Duskey Burrows, appeared before Judge Anita Ashley, yesterday, May 12, 2022 on a motion to revoke probation. Ms. Burrows did not wish to challenge the allegations and left sentencing for the courts discretion. Her previous conviction was for Possession with intent to deliver and Possession of a controlled substance with a sentence of 1-5 years. In accordance to her plea the judge is allowing consideration for her to enter a treatment facility when a bed becomes available.
