Calhoun Circuit Court Trials Continued, Court back in Session Tomorrow

Calhoun County Circuit Court was in session today with Judge Anita Harold Ashley presiding. There were four cases on the docket for trial, but each one ended with issues for continuance.

In the matter of State vs. Amy Lou Yoak, 22-F-1, charged with Grand Larceny and Burglary, she appeared with council Daniel Minardi, PDC. The case was continued following the receipt of a Forensic Psychological Evaluation. At her attorney’s request a status hearing will be held following his ”Notice to Rely on Lack of Criminal Responsibility.” The hearing is scheduled for July 6, 2022 at 2:15 p.m.

In case 22-F-13, State vs. Keith Allen Lamp, which was set for trial with a motion to reduce bond, the defendant appeared in person, while his attorney, John Balenovich, appeared via phone. Attorney Balenovich withdrew the motion to reduce bond and requested a continuance believing a plea agreement had been reached between Lamp and the State of WV. The case was continued for July 6, 2022 at 11:45 a.m.

The third matter set for trial was Case 22-F-6, and 22-F-8, State of West Virginia vs. Jesse Brent Roberts, having been charged with Possession of a Stolen Vehicle and Grand Larceny. His attorney Betty Gregory appeared by phone, at which time the State, Prosecuting Attorney Nigel Jeffries made a motion to continue to ”work out” the case. A status hearing will be held on July 21st at 2:45 p.m.

The fourth and final case was 22-F-7, State of West Virginia vs. Ricky Scruton, charged with Incest. The defendant had agreed to enter into a plea agreement with the state, but following the discovery of charges now being filed in the State of New York, (corrected from saying Wirt County) the defendant decided that it would not be in his best interest to plea. The case was continued once again for trial on October 4th at 9:00 a.m.

Court will be in session with additional cases tomorrow.
