On Wednesday, April 20, 2023, Sgt. C.J. Weekley received a call from Calhoun County 911 regarding a possible domestic in progress where the caller advised that the problem party was trying to fight the neighbors. The undersigned officer responded to the scene at 2122 Frozen Run Road Rosedale, WV (in Calhoun County. Upon arrival, Sgt. Weekley was approached by Carlos Cottrill, who was in the yard. He was very agitated, cursing repeatedly, and advising that some people had done things, like molest his children and he was going to kill them. He indicated that these people where on the property.
Cottrill advised Sgt. Weekley that his Mother, Rebecca Cottrill and his step-father, Herbert Dickey, who are both victims in this incident, lived at the residence with him.
Sgt. Weekley went tot he resident and spoke to the victims, where they advised him that they were in fear of their lives and that their son was on some kind of drug, possibly methamphetamine. Mrs. Cottrill advised that the her son also had mental problems and was not taking his prescribed medications. They advised that Carlos Cottrill wanted them to help him get the people on their property and they couldn’t because no one was actually there. When they advised that they couldn’t help him, Carlos reportedly told them that he would kill them too. They said at one point in the evening he was walking around the yard with a pitchfork in his hands. The victims were in such fear that Mr. Dickey was sitting on the couch with his pistol next to him. (Mr. Dickey is handicapped and has one leg amputated.)They said that he was wandering up and down the road and a neighbor, who he possibly also tried to fight, brought him back to the residence.
While speaking with the defendant he did advise that he smoked some methamphetamine to calm himself down that evening. During this whole incident the Carlos Cottrill was upset, moving around constantly, and did take the undersigned officer around the yard to look for the people who he thought hurt his children. During this time Sgt. Weekley did see a pitchfork lying in the yard as the victims had mentioned. Cottrill was then arrested and charged him with the domestic assault of Rebecca Cottrill and Herbert Dickey. He was taken to West Virginia Central Regional Jail.
61-2-28(b) Domestic Assault -Any person who unlawfully attempts to commit a violent injury against his or her family or household member, or unlawfully commits an act that places his or her family or household member in reasonable apprehension of immediately receiving a violent injury, is guilty of a misdemeanor and upon conviction thereof, shall be confined in jail for not more than six months or fined not more than$100, or both fined and confined.
