Duncan Sentenced for Possession with Intent to Deliver

Michael Lee Duncan appeared before Judge Anita Ashley for sentencing for Possession with Intent to Deliver in case number 22–F-39. Following a pre-sentence investigation by Probation officer Katie Nutter, Duncan, with his Attorney Daniel Minardi stood before Judge Ashley to enter his plea of guilty. Attorney Minardi, in Duncan’s defense, described Duncan’s childhood as “rough” saying that he was a victim of multiple placements getting started on the wrong foot. He said his client took responsibility for his crime and had remorse. Minardi requested that Judge Ashley take this into consideration upon sentencing and allow Duncan, who’s also being held by Wood County on charges, to serve his Wood County Sentence, Attend rehabilitation at Recovery Point in Parkersburg, a free long term Recovery Men’s Program following his release and be allowed to be on Probation on Calhoun charges with drug treatment.

Dunan’s sister appeared on his behalf expressing her love for her brother and noting the fact that he needs help and that she believes drug rehab could do wonders for him if the judge would allow it.

Duncan himself apologized to the state and to his family saying that he was sick of the drug life, jail and the people. “I’m getting older and I don’t want to spend my life chasing drugs, regardless of his sentence, I’m going to do better,” he said.

Judge Ashley informed Mr. Duncan that she had carefully reviewed his case and appreciated the family coming to court. But because of the large amount of Methamphetamine and long history of crimes: 16 misdemeanors, 7 citations, probation revocation in 2012 and his current pending charges, she was sentencing him to not less than 1 year, nor more than 15 with 228 days credit for time served. She recommend that during his incarceration he take advantage of programs such as “Goals” or “RSAT” – Residential Substance Abuse Treatment for State inmates and hopefully his time of incarceration will help.
