On April 25th, 2024, Deputy C.R. Stephens, assisted by other officers, executed a search warrant at the Justin Bordas residence. During the search, the officers located three plants believed to be, based upon training and experience, marijuana. Two of the plants were in a hydroponic device in the lone bathroom of the residence. The third plant was more mature and in a self contained indoor greenhouse type device in the garage.
Among other items taken were two smoking devices and several prescription cannabis containers containing product outside of the thirty day supply allowed to be possessed in WV Code Chapter 16A.
Bordas had previously stated during a home confinement check that his medical cannabis card allows him to have two marijuana plants, however, he has no permit from the bureau as required by WV Code 16A-3-3(b)(3). Bordas is being charged with three (3) counts of cultivation of marijuana. These crimes occurred withinthe geographical limits of Calhoun County, West Virginia.
Bordas was arrested and taken to the WV Central Regional Jail where he is being held on a $5,000 cash or surety bond on the charges of Manufacturing a controlled substance as well as a capias.
Penalties fr the violation of
60A-4-401. Prohibited acts; penalties
(a) Except as authorized by this act, it is unlawful for any person to manufacture, deliver, or possess with intent to manufacture or deliver a controlled substance.
Any person who violates this subsection with respect to:
(ii) Any other controlled substance classified in Schedule ,I, Il, or IlI is guilty of a felony and, upon conviction thereof, may be imprisoned in a state correctional facility for not less than one year nor more than five years, or fined not more than $15,000, or both fined and imprisoned;
