Klingenberg Arrested for DUI 3rd Offense in Arnoldsburg Road Crash

According to a Criminal Complaint filed by Trooper N.T. Warden of the Roane County Detachment, on
On Monday, February 27, 2023, at approximately 10 p.m. Trooper N.T. Warden, was dispatched by the Roane County 911 Center (RTC) to a single motor vehicle crash located in the 3400 Block of Arnoldsburg Road in Spencer, Roane County, West Virginia. Trooper Warden, assisted by Trooper N.S. Stepp, arrived on the scene and located the driver of the vehicle, Jalen Turner Klingenberg. During the course of the crash investigation, it was determined that the accused had been traveling west on Arnoldsburg
Road, lost control of his vehicle, ran off the left side of the road and struck a guardrail. The vehicle then traveled over a steep embankment where It came to rest. It was also discovered that the Ohlo registration displayed on the vehlcle, described as “JTL 5517,” was Improper, nor did the vehicle have insurance coverage.

Trooper Warden also noted that although the call was dispatched for Roane County, the crash actually occurred in Calhoun.

While Interacting with the accused, this trooper detected the odor of an alcohol beverage on his breath and noticed that the accused was unable to keep his balance while walking, In addition he was unable to stand upright without swaying. While speaking with the accused, this Trooper noticed that his speech was extremely slurred and sluggish.

Tpr. Warden administered to the accused the Standard Field Sobriety Test (SFST), explaining to the accused to keep his feet together, his arms to his side and to keep his head still and follow the stimulus the Trooper was using to conduct the test with only his eyes. Upon completion of this test it was noted that the Klingenberg failed this portion of the SFST as well as all other tests given.

A Preliminary Breath Test was given to the accused that revealed his BAC at that time was .242.

After performing a drivers history check it was discovered that the the accused had two prior DUI convictions through the State of Iowa with conviction dates of September 18, 2021 and April 7, 2022. Klingenburg’s drivers license was revoked for multiple DUI’s and had multiple suspensions for unpaid citations.

Klingenberg was placed under arrest and taken to the WV Central Regional Jail for DUI 3rd offense. He is currently being held on a $10,000 bond for Calhoun and a $30,000 bond for Roane County.

DUI 3rd offense is a felony under State code 17C-5-2(m). A person convicted of an offense under this section, who has previously been convicted of any offense under this section on two or more occasions, Is guilty of a felony and, upon conviction thereof, shall be imprisoned In a state correctional facility for not less than two nor more than five years, shall have his or her license to operate a motor vehicle revoked by the Commissioner of the Division of Motor Vehicles for life or for a period of time conditioned on participation in the test and lock program in accordance with §17C-5A-3a of this code, and the court may, In Its discretion, impose a fine of not less than $3,000 nor more than $5,000: Provided, That if the third or subsequent conviction is for an offense as described in subsections (b), (c), or (d) ofthis sectlon and the subsection creating the offense requires a period of incarceration, period of lIcense revocation, or fine that Is greater than what is required for a conviction under this subsection, the greater period of Incarceration, period of revocation, and fine shall be imposed.
