According to a criminal complaint filed in the Magistrate Court of Calhoun by Sgt. C.J. Weekley, Timothy Rhodes, who is required to register in Calhoun County, West Virginia as a sex offender due to a guilty plea in Roane County, WV in November 2016 for the charge of Attempting to Commit a Felony, to-wit: Soliciting a Minor via computer. In this case the victim was a minor female and the defendant was at least four years younger than the defendant at the time of the incident. Because the victim of the sexually motivated offense was a minor the defendant is required to register as a sex offender for life.
The defendant is required to register as a sex offender in Calhoun County, West Virginia because on August 17, ,2022 the defendant registered at the WV State Police Grantsville Detachment advising that he was living at 435 Arnoldsburg Road, Arnoldsburg, West Virginia (Calhoun County). The defendant is to register all required sex offender registry information at the detachment in the county he resides to wit: Calhoun County.
According to the act, the defendant is also required to register 10 business days of change of address. The undersigned officer’s investigation showed that the defendant had moved from the address of 435 Arnoldsburg Road, months prior to April 4, 2023. The defendant has not registered with the WV State Police Grantsville Detachment as required that he had moved as of the request for a warrant from this criminal complaint on June28, 2023. Mr. Rhodes has not registered at any other WV State Police Detachment with the information.
Also, during the August 17, 2022 registration, the defendant advised that he worked at D&D Motors in located at 650 Parkersburg Road Spencer, West Virginia. D&D Motors advised that on June 1, 2023, the defendant sent them a text advising that he was no longer going to work there. D&D Motors advised that he has not worked there since the date of the text. As of the request for a warrant from this criminal complaint on June 29, 2023, the defendant has not registered this change as required at the WV State Police Grantsville Detachment. This is over the 10 business day requirement to notify the WV State Police of the employment change according to the WV Sex Offender Registration Act.
Sgt. Weekley requests a warrant for two violations of WV statute 15-12-8(c) for Failure to Provide Registration Changes (Lifetime Registration) which reads: Any person required to register for life pursuant to this article who knowingly provides materially false information or who refuses to provide accurate information when so required by the terms of this article, or who knowingly fails to register or knowingly fails to provide a change in any required information as required by this article is guilty of a felony and, upon conviction thereof shall be imprisoned in a state correctional facility for not less than one year nor more than five years.
Timothy Rhodes was arrested and is being held in the Central regional jail with a $20,000 bond for Calhoun County’s 2 count arrest, and on a $70,000 bond for a Roane County arrest on five counts of the same charge.
