Sterns Charged with Aggravated DUI

Grant M. Sterns, age 22, was arrested on April 27th, 2025 and charged in Case 25M07M00082 with (1) Failure to Drive with Due Care, (2)Aggravated DUI, (3) Seatbelt violation. The following complaint was filed in Calhoun Magistrate Court on April 27th.

On April 27, 2025, al approximately 8:44 p.m. Sergeant KM Williams of the WV State Police was dispatched to a motor vehicle accident at 7454 Russett Road, Grantsville, WV.

While en route, Sgt. Williams was advised the driver was transported to Minnie Hamilton Hospital via a personal vehicle and at approximately 9:02 p.m. the office arrived and observed a silver Nissan Murano with heavy drivers side damage and airbag deployment. The officer also observed that the seatbelt was locked out and the vehicle had traveled across the roadway and struck a pole on the opposite side of the roadway.

At approximately 9:33 p.m. Sgt. Williams traveled to Minnie Hamilton Hospital where he then spoke to a male, identifted as Grant Sterns who advised that he was the driver and provided the officer a statement as such. While taking the statement this Sgt. Williams detected an odor of an Alcoholic Beverage emitting from Sterns breath along with Bloodshot eyes and slurred speech.
Al approximately 10:01 p.m.. Sterns was administered a PBT showing his BrAC was 0.199, Following Mr. Sterns
release this officer conducted a field sobriety test and placed Mr. Sterns under arrest. Mr. Sterns was transported to the Grantsville Detachment where he provided a Breath sample on the EC/IR II indicating his BrAC was 0.183 at 10:48 p.m. hours. Following arraignment he was transported the the WV Central Regional Jail.

§17C-5-2. Driving under influence of alcohol, penalties.
0 ) Any person who drives a vehicle on any public highway or private road in this state while he or she has an alcohol concentration in his or her blood of fifteen hundredths of one percent or more, by weight, is guilty of a misdemeanor
and, upon conviction thereaf, shall be confined in jail for not less than two days nor more than six months, which jail term is to include actual confinement of not less than 24 hours, and shall be fined not less than $200 nor more than $1,000, and shall have his or her license to operate a motor vehicle evoked by the Commissioner of the Division of Motor Vehicles for a period of one year or for a period of time conditioned on participation in the test and lock program in accordance with s17C-5A-3a of this code. A person sentenced pursuant to this subsection shall receive credit for any period of actual confinement he or she served upon arrest for the subject offense §17C-15-49. Operation of vehicles with safety belts; exception; penalty;
(a) A person may not operate a passenger vehicle on a public street or highway of this state unless the person, any passenger in the back seat under 18 years of age, and any passenger in the front seat of the passenger vehicle is restrained by a safety belt meeting applicable federal motor vehicle safety standards. For the purposes of this section. the term “passenger vehicle” means a motor vehicle which is designed for transporting 15 passengers or less, including the driver, except that the term does not include a motorcycle, a trailer, or any motor vehicle which is not required on the date of the enactment of this section under a federal motor vehicle safety standard to be equipped with a belt system. The provisions of this section apply to all passenger vehicles manufactured after January 1, 1967, and being 1968 models and newer.

§17C-6-1. Speed limitations generally; penalty.
(a) No person may drive a vehicle on a highway at a speed greater than is reasonable and prudent under the existing
conditions and the actual and potential hazards. In every event speed shall be controlled as necessary to avoid colliding with any person, vehicle or other conveyance on or entering the highways in compliance with legal requirements and the duty of all persons to use due care.
