Thirteen Indictments Returned by Grand Jury

RYAN ANDREW SNIDER

An indictment was returned on Ryan Andrew Snider on January 2, 2024 by the Calhoun Circuit Court Grand Jury. Snider was charged in the indictment with Manufacturing a Controlled Substance (Marijuana). The indictment stated that in October 2022, Snider did unlawfully, knowingly and feloniously manufacture, a controlled substance, to-wit: marijuana, a schedule I non-narcotic and that Ryan Andrew Snider was not a licensed medical practitioner acting in the course of a professional practice administering or dispensing a controlled substance or incidental to research, teaching, or chemical analysis, in violation of West Virginia Code 60A-4-401(a)(ii), a felony against the peace and dignity of the State of West Virginia. 

Mr. Snider appeared in Calhoun Circuit Court on January 4th, 2024 before Judge Anita Harold Ashley for his first appearance relating to 2024-F-1. Appearing with his Attorney, Public Defender Daniel Minardi, Snider was released on a $10,000 cash, property or surety bond which must be posted for his arraignment date of January 31st , have it posted before arraignment date of January 31st, 2024 at 1:45 p.m.

JAMES KEITH HARDMAN

An indictment was returned on James Keith Hardman on January 2, 2024 by the Calhoun Circuit Court Grand Jury in case 2024-F-2. Hardman was charged in Count 1 of the indictment with Failure to Register as a Sexual Offender or Provide Notice of Registration Changes. The indictment stated that James Keith Hardman did feloniously and knowingly fail to provide a change of required information pursuant to Chapter 15, Article 12 of the West Virginia Code, to wit: He failed to provide or update the West Virginia State Police with information related to the address at which he resided as required by WV Code 15-12-2(d)(2) and 15-12-3, and James Keith Hardman is required to register as a sex offender for the duration of his life by virtue of a prior conviction in Calhoun County, WV in violation of WV Code 15-12-8(c), a felony, against the peace and dignity of the State of West Virginia. 

James Keith Hardman was indicted on Count 2, of the indictment with Failure to Register as a Sexual Offender or Provide Notice of Registration Changes, having committed this crime when he did feloniously and knowingly fail to provide a change of required information pursuant to Chapter 15, Article 12 of the West Virginia code, to-wit: failed to provide or update the WV State Police with information related to the license plate on a 2011 Honda CRV driven by James Keith Hardman who is required to register as a sex offender for the duration of his life by virtue of a prior conviction in Calhoun County, WV in violation of WV Code 15-12-8(c), a felony, against the peace and dignity of the State of West Virginia. 

Found upon the testimony of Corporal Brian E. Young, WVSP, duly sworn in the presence of the Grand Jury. 

Mr. Hardman appeared in Calhoun Circuit Court on January 4, 2024, before Judge Anita Harold Ashley for his first appearance related to two aforementioned counts where he was released on bond to appear January 31st, 2024 at 1:50 p.m.

RYAN AND ELLIO HARDMAN

In Case numbers 2024-F-3 and 2024-F-4, Ryan Hardman and Ellio Hardman, were indicted by the Calhoun Circuit Court Grand Jury on January 2, 2024 of Count 1, Child Neglect with Risk of Serious Bodily Injury or Death, with the indictment stating that on or about July 2023 in the County of Calhoun, State of West Virginia, they did unlawfully, feloniously, and grossly neglect OJH, a minor child, while serving as parents, guardians or custodians to the minor child, and the said gross neglect created a substantial risk of death or serious bodily injury to the minor child OJH as defined in WV Code 61-8D-1(6) a felony in violation of WV Code 61-8D-4(c), against the peace and dignity of the State. 

Count two of the indictment against Ryan and Ellio Hardman stated that on or about July 2023 in the County of Calhoun, State of West Virginia, they did intentionally and feloniously conspire to commit the crime of Child Neglect with Risk of Serious Bodily Injury or Death, a felony, with each other and that one or more of Ryan Hardman and Ellio Hardman committed some act in furtherance of said conspiracy, by committing the crime of Child Neglect with Risk of Serious Bodily Injury as alleged in Count 1 herein, said act being a felony in violation of WV Code 61-10-31and being against the peace and dignity of the State of West Virginia.

Found upon the testimony of Corporal Brian E. Young, WVSP, duly sworn in the presence of the Grand Jury. 

Brian and Ellio Hardman appeared before Judge Anita Harold Ashley on January 4th, 2024 for their first appearance. Both are incarcerated in the WV Central Regional Jail, Bonds were continued and the defendants will return for arraignment on January 31st, 2024 at at 1:55 p.m.

JOSEPH EARL YOAK

An indictment was returned on Joseph Earl Yoak on January 2, 2024 by the Calhoun Circuit Court Grand Jury in case 2024-F-6. Mr. Yoak was charged in Count 1 of the indictment with the crime of Possession of a Firearm by a Prohibited Person when he did knowingly and feloniously possess a firearm when he was previously convicted of a felony sexual offense in the State of Kentucky in 2006, a felony, in violation of WV code 61-7-7(b)(1). 

Yoak was indicted on Count 2, Failure to Register or Provide Notice of Registration Change, when he did knowingly, unlawfully and feloniously fail to provide a change of required information pursuant to Chapter 15, article 12 of the West Virginia Code, to-wit: Joseph Earl Yoak failed to provide or update the West Virginia State Police with information related to any and all telephone numbers that the said Joseph Earl Yoak has or uses, including, but not limited to, residential, work and mobile numbers as required by WV Code 15-12-2(d)(9) and 15-12-3, who is required to register as a sex offender for the duration of his life by virtue of a prior conviction in the State of Kentucky, in violation of WV Code 15-12-8(c), a felony against the peace and dignity of the State of West Virginia.

The third count that Joseph Yoak was indicted for was Failure to Register or Provide a Notice of Registration Change when he did fail to provide the WV State Police employment information as required by WV Code 15-12-2(d)(2) send 15-12-3 and the said Joseph Earl Yoak is required to register as a sex offender for the duration of his life by virtue of a prior conviction in the State of Kentucky, in violation of WV Code 15-12-8(c), a felony against the peace and dignity of the State of West Virginia.

Found upon the testimony of Corporal Brian E. Young, WVSP, duly sworn in the presence of the Grand Jury. 

Joseph Earl Yoak appeared before Judge Anita Harold Ashley for his first appearance where he was ordered to return on January 31st, 2024 at 2 p.m. for arraignment. Yoak is currently housed in the WV Central Regional Jail where his bond will continue.

MARK CHRISTOPHER DONEGAN

An indictment was returned on January 2nd, 2024 by the Calhoun Circuit Court Grand Jury against Mark Christopher Donegan in case 2024-F-9 stating that on or about December 2023, in Calhoun County, West Virginia he committed the crime of  Count 1: Wanton Endangerment when he did feloniously and wantonly perform an act with a firearm which created a substantial risk of death or serious bodily injury to Devin Nichols., said act being in violation of WV Code 61-7-12 and being against the peace and dignity of the State of West Virginia.

Count 2: Wanton Endangerment when he did feloniously and wantonly perform an act with a firearm which created a substantial risk of death or serious bodily injury to Terrie Nester Donegan, said act being in violation of WV Code 61-7-12 and being against the peace and dignity of the State of West Virginia.

Count 3: Wanton Endangerment when he did feloniously and wantonly perform an act with a firearm which created a substantial risk of death or serious bodily injury to R.D.III, a minor child, said act being in violation of WV Code 61-7-12 and being against the peace and dignity of the State of West Virginia.

Count 4: Domestic Assault when Mark Christopher Donegan did unlawfully and intentionally commit an act that placed Devin Nichols, a household member, in reasonable apprehension of immediately receiving a violent injury, said act being in violation of WV Code 61-2-28(b) and being against the peace and dignity of the State of West Virginia 

Count 5: Domestic Assault when Mark Christopher Donegan did unlawfully and intentionally commit an act that placed Terrie Nestor-Donegan, a household member, in reasonable apprehension of immediately receiving a violent injury, said act being in violation of WV Code 61-2-28(b) and being against the peace and dignity of the State of West Virginia 

Count 6: Domestic Assault when Mark Christopher Donegan did unlawfully and intentionally commit an act that placed R.D. III, a minor child, a household member, in reasonable apprehension of immediately receiving a violent injury, said act being in violation of WV Code 61-2-28(b) and being against the peace and dignity of the State of West Virginia 

Mr. Donegan appeared before Judge Anita Harold Ashley on January 4th, 2024 for his initial appearance. He was ordered to return for arraignment on January 31st, 2024 at 2:05 p.m.

JONATHAN PAUL HANLEY

An indictment was returned on January 2nd, 2024 by the Calhoun Circuit Court Grand Jury against Jonathan Paul Hanley in case 2024-F015 charging Failure to Register as a Sexual Offender or Provide Notice of Registration Changes. The indictment stated that Hanley failed to provide or update the West Virginia State Police with information related to the address at which he resided as required by the WV Code 15-12-2(d) and 15-12-3, and that Mr. Hanley is required to register as a sex offender for the duration of his life by virtue of a prior conviction in Taylor County, West Virginia in violation of WV Code 15-12-8(c), a felony against the peace and dignity of the the State of West Virginia. 

Found upon the testimony of Trooper Brandon Shingleton, WVSP, duly sworn in the presence of the Grand Jury to testify and thereupon testifying before the Grand on the 2nd day of January, 2024. 

Jonathan Paul Hanley appeared before Judge Anita Harold Ashley on the the 4th day of January, 2024 for his initial appearance and was ordered to return for arraignment on January 31st, 2024 at 2:10 p.m.

ISAAC CHARLES GROUNDS

An indictment was returned on January 2nd, 2024 by the Calhoun Circuit Court Grand Jury against Isaac Charles Grounds for Driving on a Revoked License for DUI-Third Offense. The indictment stated that Grounds did unlawfully and feloniously drive on a public highway of the State of West Virginia at a time when his privilege to do so had been previously and lawfully revoked for driving under the influence of alcohol, controlled substances or other drugs or any combination thereof, or for driving while having an alcoholic concentration in his blood of eight hundredths of one percent or more, by weight, or for refusing to take a secondary chemical test of blood alcohol content and the said Isaac Charles Grounds has been twice previously convicted of driving on a revoked license for driving under the influence of alcohol, controlled substances or other drugs, or any combination thereof, or for driving while having an alcoholic concentration in his blood of eight hundredths of one percent or more, by weight, or for refusing to take a secondary chemical test of blood alcohol content, to-wit: on April 17th, 2012 in Calhoun County, WV and March 14, 2016 in Wirt County, WV in violation of WV Code 17B-4-3(b), a felony against the peace and dignity of the State of West Virginia. 

Found upon the testimony of Joshua D. Richards, WVSP, duly sworn in the presence of the Grand Jury to testify and thereupon testifying before the Grand Jiury on the 2nd day of January 2024. 

Mr. Grounds appeared before Judge Anita Harold Ashley on January 4th, 2024 for his initial appearance at which time he was ordered to return for arraignment on January 31st at 2:15 p.m.

JAMES MICHAEL JONES

The Grand Jury returned an indictment against James Michael Jones on January 2nd, 2024 charging Jones in Case 2024-F-5 with Count 1: Possession of a Firearm by a Prohibited Person when Jones did knowingly and feloniously possess a firearm and was previously convicted in Calhoun County of a felony controlled substance involving methamphetamine in case 2005-F-7, a felony in violation of WV Code 61-7-7(b)(2).

Jones was charged with Count 2: Wanton Endangerment when he did feloniously and wantonly perform an act with a firearm which created a substantial risk of death or serious bodily injury to Robert Williams, said act being in violation of the WV Code 61-7-12 against the peace and dignity of the State of West Virginia. 

Found upon the Testimony of Corporal Brian E. Young, WVSP, duly sworn in the presence of the Grand Jury to testify and thereupon testifying before the Grand Jury on the 2nd day of January, 2024. 

James Michael Jones Appeared on January 4th, 2024 before Judge Anita Harold Ashley and was ordered to return for arraignment on January 31st, 2024 at 2:20 p.m.

DAVID LEE AND KATHY DIANE GOODRICH

The Grand Jury of Calhoun County Circuit Court returned an indictment on January 2nd, 2024 against David Lee Goodrich and Kathy Diane Goodrich in Cases 2024-F-10 and  2024-F-11, stating that in February 2023 in the County of /Calhoun, State of West Virginia, they did unlawfully, knowingly, and feloniously manufacture, as the term is defined by WV Code 60A-1-101(q) a controlled substance, to-wit: Marijuana, a schedule 1 non narcotic, and the Goodrich’s were not licensed medical practitioners acting in the course of a professional practice administering or dispensing a controlled substance or incidental to research, teaching or chemical analysis, in violation of WV Code 60A-4-401(a)(ii), a felony, against the peace and dignity of the State of West Virginia. 

Count 2: Conspiracy to Commit a Felony, in that David and Kathy Goodrich did in February 2023 in the County of Calhoun, State of West Virginia, intentionally and feloniously conspire to commit the crime of Manufacturing a Controlled substance, to wit: Marijuana, a felony, with each other and that one or more did commit some act in furtherance of said conspiracy by committing the crime of Manufacturing a Controlled substance, to-wit: , a felony as alleged in Count 1, in violation of WV Code 61-10-31 and being against the peace and dignity of the State of West Virginia. 

Found upon the testimony of Trooper Seth McDonald, WVSP, duly sworn in the presence of the Grand Jury to testify and thereupon testifying before the Grand Jury on the 2nd day of January 2024.

David and Kathy Goodrich appeared before Judge Anita Harold Ashley on January 4th, 2024. Bond was posted for David Goodrich by a property bond and Kathy was released on a $10,000 Personal recognizance bond, both ordered to return for arraignment on January 31st, 2024 at 2:30 p.m.

JAMIE D. BAILEY AND JONATHAN DAVID MCINTYRE

In Case 2024-F-7 and 2024-F-8 the Calhoun Circuit Court Grand Jury returned a 4 count indictment against Jamie D. Bailey and Jonathan David McIntyre stating that on or about July 2023 in the County of Calhoun, State of West Virginia, they did feloniously and intentionally possess a stolen good, to-wit: a utility trailer with a value in excess of $1,000 and they knew or had reason to know the said utility trailer had been stolen, in violation of WV code 61-3-18, a felony, against the peace and dignity of the State of West Virginia,  

Count 2: Jamie Bailey and Jonathan McIntyre did on or about July of 2023, in the County of Calhoun, State of West Virginia, feloniously and intentionally possess a stole vehicle, to-witness: a 2022 Dodge Ram pick up truck of the value in excess of $1000 when the said Baily and McIntyre had the said vehicle in their possession which they knew or had reason to believe had been stolen or unlawfully taken, and they were not officers of the law engaged at the time in the performance of the duties of such officers, a felony in violation of WV Code 17A-8-5, against the peace and dignity of the State of West Virginia. 

Count 3: Jamie Bailey and Jonathan McIntyre did on or about July 2023 in the County of calhoun, State of West Virginia, intentionally and feloniously conspire to commit the crime of transferring or receiving stolen property, a felony with each other and that one or both committed some act in furtherance of said conspiracy by committing the crime of Transferring or receiving stolen property, a felony, as alleged in Count 1, said act being a felony in violation of WV Code 61-10-31 and being against the peace and dignity of the State of West Virginia. 

Count 4: Jamie Bailey and Jonathan McIntyre did on or about July 2023 in the County of Calhoun, State of West Virginia intentionally and feloniously conspire to commit the crime of possession of a stolen vehicle, a felony when they committed some act in furtherance of said conspiracy by committing the crime of Possession of a Stolen Vehicle, a felony alleged in Count 2 herein, said act being a felony in violation of WV Code 61-10-31 and being against the peace and dignity of the State of West Virginia.

Found upon the testimony of Corporal Nathan S. Stepp, WVSP, duly sworn in the presence of the Grand Jury to testify and thereupon testifying before the Grand Jury on the 2nd day of January 2024.

Jamie Bailey and David McIntyre appeared before Judge Anita Harold Ashley on January 4th, 2024 where they were ordered to appear for arraignment on January 31st, 2024 at 2:35 p.m.

KRISTINA DAWN KIRKBRIDE

The Grand Jury of Calhoun Circuit Court returned an indictment on January 2, 2024 in case 2024-F-14 against Kristina Dawn Kirkbride for Delivery of a Controlled Substance, stating that on or about February 2023, in Calhoun County, West Virginia, Kirkbride did knowingly and feloniously deliver to Victor Carpenter a controlled substance, to-wit: fentanyl, a Schedule II controlled substance, and was not a licensed medical practitioner acting in the course of her professional practice in violation of WV Code 60A-4-401(a)(i), a felony against the peace and dignity of the State of West Virginia. 

Found upon the testimony of Sergeant Christopher J. Weekley, WVSP, duly sworn in the present of the Grand Jury to Testify and thereupon before the Grand Jury on the 2nd day of January 2024. 

Kristina Dawn Kirkbride did not appear before Judge Anita Harold Ashley, with Prosecutor Michael Hicks believing they would be able to arrest her before the January 31st day of arraignments.

In Case Number 2023-F-19, Charter Badgett appeared before Judge Anita Harold Ashley for a Pretrial conference. The case was continued until February 15th, 2024 at 1:30 p.m.

Christopher Allen Johnson, Case Number 2023-F-18, appeared before Judge Anita Harold Ashley for a Pretrial conference. The Case was continued until February 1, 2024 at 11:30 a.m. for Pretrial, and a trial date of March 5th, 2024 was set for 9 a.m.
