Winnell arrested for Domestic Assault

On Sunday, January 21, 2024, at approximately 7:17 p.m., Sergeant KM Williams of the West Virginia State Police, was dispatched to 4597 South Calhoun Highway, Grantsville, WV.

Calhoun 911 advised that the wife of Noel G. Winnell called and advised that she and her husband were in an argument and that he was going frantic over the location of his pistol. 911 advised that Noel was yelling in the background and that Susan advised that she had moved the firearm so that he could not locate it at the time.

On the same date, at approximately 7:22 p.m. , Sgt. Williams spoke to Mr. and Mrs Winnel. Mrs. Winnel was very emotional and was crying, stating to the officer that she was in fear for her safety cause he had been drinking all day and was on a FaceTime call with his brother , yelling and screaming, which woke her from her sleep.

When she came out to the table he continued to argue with his brother, she then left and went back into the bedroom. Mr. Winnel folowed her into the bedroom and asked Mrs. Winnell if she was ok, and noticed that she was on the phone. Mr. Winnell then went back to the kitchen and then returned to the bedroom. Mr. Winnell asked who she was on the phone with and she advised she was on the phone with the cops. When Mr. Winnell left the bedroom he noticed that the handgun was not where it was supposed to be. Mr. Winnell stated to this Sgt. Williams that he became concerned for his safety due to the last incident. Mr. Winnell then when back into the bedroom and asked her where the firearm was. Mrs. Winnell refused ot tell him where she moved the firearm and the argument continued to get louder and louder arguing over the firearm.

Sgt. Williams statement noted that he detected the odor of an alcohol beverage on both there persons. Mr. Winnell was arrested and transported to the Grantsville State Police Detachment for processing, a PBT was giving to Mr. Winnell and he blew a 0.128% BrAC and upon completion of processing to the Calhoun County Magistrate for arraignment.

Noel Winnell is innocent until proven guilty in a court of law.

§61-2-28(b) Domestic assault is defined as: Any person who unlawfuly atempts ot commit aviolent injury against his or her family or household member, or unlawfully commits an act that places his or her family or household member ni reasonable apprchension of immediately receiving a violent injury, is guilty of a misdemeanor and, upon conviction thereof, shall be confined ni jail for not more than six months or fined not more than $100, or both fined and confined.

  1. Hi. This is Susan Hubbard Winnell. I would like to point out a couple of inaccuracies. “Mr. Winnell asked who she was on the phone with and she advised she was on the phone with the cops. When Mr. Winnell left the bedroom he noticed that the handgun was not where it was supposed to be.” Mr. Winnell didn’t ask me who I was on the phone with. He didn’t even notice the phone was on a call on the nightstand farthest away from him. “When she came out to the table he continued to argue with his brother, she then left and went back into the bedroom.” This is incorrect. On my way back to our bedroom, I moved his pistol to another area of the living room hoping that he wouldn’t find it. “Mr. Winnell then went back into the bedroom and asked her where the firearm was. Mrs. Winnell refused to tell him where she moved the firearm and the argument continued to get louder and louder arguing over the firearm.” I personally was not arguing with Mr. Winnell when he came back into the bedroom. I quietly told him I didn’t know where it was. I did not believe it was safe for him to have it at that time. Just as a follow-up for you, at his Pre-Trial Hearing I personally talked to the prosecutor and explained that no direct threat had been made to me by Mr. Winnell. I was just concerned for everyone’s safety. All charges were dismissed. Mr. Winnell is facing two separate neck surgeries and has been in agony for two years. The surgery could leave him paralyzed from the neck down. I believe he may have been self-medicating for the pain and stress. God bless.
