Tallhammer Accepts a High/Low Plea Agreement in Circuit Court

Timothy Lee Tallhammer was on the docket for trial,, Tuesday, July 25th, 2023 but decided rather to enter into a plea agreement with the State of West Virginia. Tallhammer, defended by Attorney Daniel Minardi, was charged with Driving on a Suspended License 3rd offense and faces not less than 1, nor more than 3 years, and not less than a $3,000 fine, nor more than a $5,000 fine if convicted. 

But, as a part of the High/Low plea agreement, Tallhammer’s case will be deferred as he continues participating in drug court. If a he has a successful completion of the program he will be allowed to enter a plea to a lesser included misdemeanor charge of, Possession of a Control Substance (meth). A conviction on the lesser charge would have him face 90 days to 6 months in jail, and a fine of not less than $100, nor more than $500.00. Court costs will be assessed in either case. 

The charges against Tallhammer stem from a traffic stop by WV State Police Trooper Brian Young, who initially made the stop for an expired inspection sticker in October of 2022. Tallhammer confessed to Trp. Young at the time that he did not have a license and following a search of the car, Tallhammer was found to be in possession of drugs and taken into custody. 

Judge Anita Ashley referred the case to probation for a pre-sentence investigation. Sentencing is scheduled for Thursday, September 7 at 9 a.m.
