In a complaint filed by Deputy H. Stephens on September 8th, 2024, Stephens stated that at approximately 8:15 a.m. Deputy C.R. Stephens and Deputy H. Stephens arrived at a residence on Hughes Fork Road, responding to a complaint of an individual pointing a gun at another person. The Deputies were informed that the Joseph Smith, had pointed a gun at
A 17-year-old male riding his motor bike on Rowles Run when Mr. Smith was driving toward him, traveling the opposite direction.
Mr. Smith reportedly opened his car door in an attempt to knock the motor bike driver off of his motor bike, then pointed a gun at him. Mr. Smith withdrew the gun and left the scene when another individual drove up on scene.
After speaking with witnesses at the scene and another gentleman who came upon the scene, it was stated that the juvenile was visibly shaken and needed help picking up his motorbike after the incident.
Deputy C.R. Stephens and Deputy H. Stephens spoke with the juvenile who stated that while they were passing each other in the roadway on Rowles Run, Mr. Smith had open the car door of his gray Toyota Corolla, trying to knock him off of his bike and told him to “slow the f* down.” When the juvenile asked “What his (Smith’s) problem was?” Smith pointed a black pistol at the juvenile and yelled other profanity. The juvenile said he backed away and put his hands in the air when another car came around the corner.
After speaking with the juvenile, the Deputies arrived at 62 Hughes Fork to speak with Mr. Smith. They were met by both Mr. Smith and Nancy Kirby. Mr. Smith provided his identification, but he and Mis. Kirby were both verbaly uncooperative, stating that they were tired of the police being called to their house. At one point, Ms. Kirby demanded that the officers leave her property because they were trespassing, then called dispatch to send an officer to remove them. Mr. Smith asked for his identification to be returned to him, but was denied at the time because the officers were still awaiting a response from dispatch on a prohibited status. They then stated that he could not be detained because he was not in handcuffs. When Deputy C.R. Stephens relayed that he was being accused of opening his car door to knock someone over and of pointing a gun at someone, Mr. Smith replied “oh. Really?” Mr. Smith never denied that he had pointed a gun. He instead said that he had not opened his door. Smith stated that he had yelled at a kid on a bike to “slow the f down.” He said that the kid screamed profanity” and that was the end of the altercation.
Smith was arrested on October 1st, 2024 and released on a $3,000 bond.
