
This story had me confused…
The victim of this story was not Gary A. Farrell but rather, the neighbor of Gary Paul Farrell, Joshua Bopp. Ferrell’s son, Gary A. Ferrell was a witness to the incident.
The complaint is now posted as Senior Trooper J.D. Richards filed it in the Magistrate Court, written in first person by the Trooper.
On Saturday, October 18th, 2025, at approximately 1042 hours, Senior Trooper J.D. Richards, hereinafter referred to as this Trooper, was advised by Calhoun County dispatch that there was a disturbance near the address of 760 Tipton
Road, Big Springs, Calhoun County, WV 26151. This Trooper was advised that a Gary P. Ferrell subject, hereinafter referred to as the suspect, who was familiar to this Trooper, had an altercation with his neighbor involving a firearm.
On the same date, at approximately 1120 hours, this Trooper arrived on scene. This Trooper spoke with the suspect, who was down the road from his residence approximately 150 feet. The suspect advised that his neighbor pulled a gun on
him. The suspect advised that the victim then got in his truck and was pointing the gun at him as he drove away. The suspect then advised that he threw rocks and put two (2) holes in the back glass of the victim’s truck. EMS personnel
arrived on scene with this Trooper and the suspect was transported to Minnie Hamilton Health System in Grantsville, WV to be seen.
This Trooper then spoke with Gary A. Ferrell, hereinafter referred to as the witness. The witness advised that the suspect had just got “his shot” today and that he was “off his rocker”. The witness advised that he was trying to prevent
the situation from happening. The witness advised that the suspect was flagging the victim. The witness advised that he broke the victim’s window. The witness also advised that the suspect used rocks to bust out the windows. The witness then advised that the victim pulled a gun on the suspect but did not blame the victim because the suspect was acting erratic and the suspect brandished a knife. The witness advised that the victim did not pull a gun on the suspect until well after he had already been assaulted and the suspect was in his window “trying to punch him in the face”. The witness advised that he didn’t know whether the suspect landed a punch on the victim or not but knew he was attempting to.
This Trooper remained on scene and spoke with the victim. This Trooper also observed the victim’s vehicle: a red in color Chevrolet Pickup bearing Ohio Registration which had two (2) rock-shaped holes in the back glass and a shattered front glass. This Trooper also observed one of the rocks still
laying in the bed of the truck. The victim advised that he was driving past the suspect’s residence when suspect came running up to his vehicle with the witness, was waving his arms. The victim advised that he thought the witness
was trying to wave him down to stop, so he stopped. The victim then advised that the suspect ran up to the driver’s side window which the victim had rolled down and started yelling at him profusely. He then advised that the suspect punched him in the left side of his face with a closed fist. The victim advised that this was the point when the victim pulled a firearm out advising that he was not going to be assaulted anymore. The victim then advised that the suspect
pulled out a knife. He described this as a small pocket knife. The victim then described that the suspect backed up and then grabbed a rock and started to approach him with it raised in a throwing position. The victim then described that the witness attempted to calm the suspect down. The victim then proceeded to get in his truck when the suspect threw two (2) rock through the back glass of his truck window. The victim then advised that he left going back to his residence. This Trooper observed slight swelling on the left-side of the
victim’s face. This Trooper took photographs of the swelling on the victim’s face along with photographs of the damage to the victim’s vehicle.
Given the facts, this Trooper is humbly requesting an arrest warrant be issued for Gary Paul Ferrell for Destruction of Property (misdemeanor), Assault and Battery.
Gary P. Farrell was charged with misdemeanor destruction of property and assault and battery. He is considered innocent until proven guilty.
All acts occurred in Calhoun County, WV.
§61-2-9. Malicious or unlawful assault; assault; battery; penalties b) Assault. — Any person who unlawfully attempts to commit a violent injury to the person of another or unlawfully commits an act that places another in reasonable apprehension of immediately receiving a violent injury is guilty of a misdemeanor and, upon conviction thereof, shall be confined in jail for not more than six months or fined not more than $100, or both fined and confined.
(c) Battery. — Any person who unlawfully and intentionally makes physical contact of an insulting or provoking nature to the person of another or unlawfully and intentionally causes physical harm to another person is guilty of a misdemeanor and, upon conviction thereof, shall be confined in jail for not more than twelve months or fined not more than $500, or both fined and confined.
§61-3-30. Removal, injury to or destruction of property, monuments designating land boundaries and of certain no trespassing signs; penalties.
(a) If any person unlawfully, but not feloniously, takes and carries away, or destroys, injures or defaces any property, real or personal, of another, he or she is guilty of a misdemeanor
and, upon conviction thereof, shall be fined not more than $500, or confined in the county.
