Following the refusal of the Town of Grantsville to pay the O&M General Manager wages of recently hired Brian Arthur. Mr. Arthur issued the formal resignation and determination of filing suit below:

Please accept this letter as formal notification of my resignation from my position as General Manager effective
January 16, 2026.
I am further formally notifying you of my intent to commence legal action against you due to your failure to pay my wages in accordance with the signed Offer of Employment. I have met my obligations under the terms of the Offer of Employment. Despite my requests to be placed on payroll and provided with a company vehicle and fuel card, you have failed to satisfactorily resolve this matter. Therefore, I am prepared to initiate legal proceedings to seek compensation and remedial measures unless you pay what is owed under the Offer of Employment.
To that end, I am formally requesting $10,000.00 to cover lost wages, accrued sick and annual leave, health insurance, personal vehicle wear and tear, and fuel. I expect payment by January 29, 2026. Failure to respond may result in the initiation of legal proceedings and will result in higher damages.
See W. Va. Code § 21-5-4(e) (“If a firm, person, or corporation fails to pay an employee wages as required under this section, the person, firm, or corporation, in addition to the amount which was unpaid when due, is liable to the employee for two times that unpaid amount as liquidated damages.”); see also W. Va.
Code § 21-5-1(c) (“the term ‘wages’means compensation forlabor or services rendered by an employee…. [The term *wages shall also include then accrued fringe benefits capable of calculation and payable directly to an employee.”). If forced to file suit, this action will not only seek resolution as mentioned but may also include recovery of attorney’s fees, court costs, and other damages as legally allowable.
