
In a complaint filed by Prosecutor Michael Hicks in the office of Magistrate Lora Davis on July 25th, 2025 it was stated that on Friday, December 13, 2024, a theft complaint was received from Allen and Debra Smith in Calhoun County, West Virginia. The Smiths reported that at 9:30 a.m. on the same date, they observed two male subjects in a white in color Dodge Caravan
near an old farmhouse owned by the Smiths that was now used for storage.
Mrs. Smith was able to photograph the van as it was leaving and captured the license plate number. A check through WVSP Communications revealed that the 2016 Dodge Carvan with was registered to a Kennedy subject in Spencer, West Virginia.
On Friday, December 13, 2024, Deputy J.B. Hunt of the Calhoun County Sheriff’s Department received information that the driver of the white Dodge Caravan was suspected of being Nicholas Tyler Roberts.
On Saturday, December 14, 2024, Deputy J.B. Hunt received information from Senior Trooper J.A. Miller of the West Virginia State Police Spencer Detachment that he and Roane County
Deputy Sheriff T.M. Lanier had traveled to Vandal Fork Road in Spencer, West Virginia, located the Dodge Caravan, and had spoken with the owner who advised that Nicholas Tyler Roberts had taken the van without her permission. While at the residence Sr. Tpr. Miller and Deputy Lanier observed and located various items including a plastic container containing ammunition, one (1) Beeman air rifle; one (1) New England Firearms .410, break down shotgun; one (1) “Crate” guitar amplifier; two (2) assault style pellet rifles with the name “Dakota” written on them (it is noted that “Dakota” is the victims’ grandson); two (2) Snap-On brand bicycles. Additionally, a pry bar and bolt cutters were located in the Dodge Caravan.
On Sunday, December 15, 2024, Deputy J.B. Hunt of the Calhoun County Sheriff’s Department traveled to the Smith’s residence where the Smith’s identified Nicholas Tyler
Roberts as the driver of the Dodge Caravan. The Smiths were also able to identify these items as being items that were stored at the farmhouse or adjoining structures to their home in Calhoun County, West Virginia. The total value of the missing and recovered items totals in excess of
$1,000.00.
A warrant was requested and issued for Nicholas Tyler Roberts who is charged Grand Larceny and Entry of Building Other Than Dwelling.

If any person shall, at any time, break and enter, or shall enter without breaking, any office, shop, storehouse, warehouse, banking house, or any house or building, other than a dwelling
house or outhouse adjoining thereto or occupied therewith, any railroad or traction car; propelled by steam, electricity or otherwise, any steamboat or other boat or vessel, or any
commercial, industrial or public utility property enclosed by a fence, wall, or other structure erected with the intent of the property owner of protecting or securing the area within and its contents from unauthorized persons, within the jurisdiction of any county in this state, with intent to commit a felony or any larceny, he or she shall be deemed guilty of a felony and, upon conviction, shall be confined in a state correctional facility not less than one nor more than 10 years.

If a person commits simple larceny of goods or chattels of the value of §1,000 or more, such person is guilty of a felony, designated grand larceny, and, upon conviction thereof, shall be imprisoned in the penitentiary not less than one nor more than ten years, or, in the discretion of the court, be confined in jail not more than one year and shall be fined not more than $2,500.
