In a complaint filed by Trooper Brian E. Young, of the West Virginia State Police, it was stated that Samuel Garcia of Grantsville, WV did violate a Domestic Violence Order and commit the crime of Stalking/Harassment on or about February 29th, 2024.
At approximately 8:20 p.m. Trooper Young received a dispatch from Calhoun Control in reference to a Domestic Violence Order violation, when the victim contacted Calhoun Control stating that Samuel Garcia, an ex boyfriend, was outside of her residence yelling, calling her names and threatening her. She stated that there was a DVP order in place and that she was in fear for her safety.
Trooper Young proceeded to her residence and spoke to the victim who stated that the Garcia was outside of her residence yelling and threatening her from the outside. She stated that she did not go to the windows and look to see the defendant but recognized his voice because it was right outside of her residence and she knew and recognized him.
Trooper Young, along with Sheriff Graham Knight then searched the area for the accused. He was found shortly thereafter at his residence in Grantsville. When the officers spoke to the accused who stated he had been at his residence the entire day except for a trip to the Dollar Store around 7:30 a.m. The accused then advised that he should not be on Mill Street and he should refrain from being near the residence as he was then directed in his DVP that was served on him on or about January 3rd, 2024 which prohibits him from being with 100 feet of the residence. The accused acknowledged that he was aware of the DVP.
Officers Young and Knight returned to the area of the victim and canvassed the area, locating security cameras with footage that revealed the accused had been at the residence of the victim at the precise time that she heard him yelling outside of her residence.
Samuel Garcia was arrested and taken to the WV Central Regional Jail where he is being held on a $15,000 cash only bond awaiting trial.
