Grand Jury Returns Three Indictments

The Grand Jury of Calhoun County convened on December 3rd, 2025 in the Circuit Court of Calhoun County and returned the following indictments:

  • 2025-F-26
    • State of West Virginia vs. Daniel Mark Johnson
      • Count 1: Entry of Building other than a Dwelling
      • That Daniel Mark Johnson on or about April 2025 in the County of Calhoun, State of West Virginia committed the crime of Entry of Building other than a Dwelling when Daniel Mark Johnson did unlawfully and feloniously break and enter a closed building to wit: Eastern Gas Transmission and Storage, Inc. building located at 1028 Klipstine Road Big Springs, WV 26137, with the intent to commit a larceny therein, a felony in violation of WV Code §6-3-12, and being against the peace and dignity of the State of West Virginia.
      • Count 2: Grand Larceny
      • That Daniel Mark Johnson on or about April 2025 in the County of Calhoun, State of West Virginia, committed the crime of Grand Larceny when Daniel Mark Johnson did unlawfully and feloniously take property with the intent to permanently deprive the owner, Eastern Gas Transmission and Storage, Inc of the following: (1) Kobalt greas gun; (1) Kobalt circular saw; (1) 240 Stihl weed eater; (1) 250 Stihl Weed eater; (1) Stihl backpack leaf blower; (2) 24-volt Kobalt chargers; (1) 12-volt Milwaukee charger;(1) 18-volt dual Milwaukee charger; (4) 24-volt Kobalt batteries; (3) 18-volt Milwaukee batteries; (2) 12-volt Milwaukee batteries; (1) 18-volt Milwaukee leaf blower; (1) two-inch water pump; (2) five-gallon gas cans; miscellaneous stand tools; spray paint; penetrating oil; miscellaneous nuts, bolts and screws; fire resistant clothing, including a Carhartt Jacket with patches and Carhartt bibs, with a total value of $1,000.00 or more, said act being in violation of WV Code §61-3-13(a), and being against the peace and dignity of the State of West Virginia.
      • County 3 – Destruction of Property
      • That Daniel Mark Johnson on or about April 2025 in the County of Calhoun, State of West Virginia, committed the crime of Destruction of Property when Daniel Mark Johnson did unlawfully, willfully, and intentionally and feloniously destroy, injure, or deface the personal property of Easter Gas Transmission and storage, Inc. during the same act or series of acts, or course of conduct causing a loss in the value of personal property in the amount of $2,500.00 or more, a felony in violation of WV Code §61-3-30(b), and being against the peace and dignity of the State of West Virginia.
      • Found upon the testimony of Deputy Hannah M. Stephens, Calhoun County Sheriff’s Department, duly sworn in open court to testify to the truth and sent before the said Grand Jury to give evidence on this indictment on the 3rd day of December 2025.

    • State of West Virginia vs. Dale Shannon Corder
      • Count 1 – Fraudulent Registration
      • That Dale Shannon Corder on or about June of 2025 in the County of Calhoun, State of West Virginia, did unlawfully, knowingly, and feloniously alter with fraudulent intent a registration plate on said Dale Shannon Corder’s Dodge Charger in violation of West Virginia Code § 17A-9-4(1), a felony against the peace and dignity of the State of West Virginia.
      • Count 2 – No Motor Vehicle Insurance
      • That Dale Shannon Corder on or about June 2025 in the County of Calhoun, State of West Virginia, did unlawfully operate a vehicle on a road or highway in the aforesaid county and state without required security (insurance), in violation of Code §17D-2A-3(a), a misdemeanor, against the peace and dignity of the State of West Virginia.
      • Count 3 – Operating Motor Vehicle Without Valid Motor Vehicle Inspection
      • That Dale Shannon Corder on or about June 2025 in the County of Calhoun, State of West Virginia, did unlawfully operate a vehicle required to be inspected without having displayed on said vehicle a current and valid certificate of inspection and failed to produce said certificate of inspection of demand of the said Dale Shannon Corder in violation of West Virginia Code §17C-16-9, a misdemeanor, against the peace and dignity of the State of West Virginia.
      • Count 4 – No Vehicle Registration
      • That Dale Shannon Corder on or about June 2025 in the County of Calhoun, State of West Virginia, did unlawfully operate a vehicle required to be registered upon a high in in the aforesaid state and county, and a valid registration plate was not attached thereto or displayed on said vehicle, nor was a valid registration plate in the possession of the operator, the said Dale Shannon Corder, in violation of West Virginia Code §17A-9-2(a), a misdemeanor, against the peace and dignity of the State of West Virginia.
      • Found upon the testimony of Deputy Charles R. Stephens, Calhoun County Sheriff’s Department, duly sworn in open Court to testify to the truth and sent before the said Grand Jury to give evidence on this indictment, on this 3rd day of December 2025.

    • State of West Virginia vs. Noah Richard Tribioli
    • Count 1 – Murder
      • That Noah Richard Tribioli on or about December 2024 in the County of Calhoun, State of West Virginia, committed the crime of Murder when the said Noah Richard Tribioli did feloniously, willfully, maliciously, deliberately, and unlawfully slay, kill, and murder Jodie L. Tribioli, in violation of WV Code §61-2-1, and being against the peace and dignity of the State of West Virginia.
      • Count 2 – Murder
      • That Noah Richard Tribioli on or about December 2024 in the County of Calhoun, State of West Virginia, committed the crime of Murder when the said Noah Richard Tribioli did feloniously, willfully, maliciously, deliberately, and unlawfully slay, kill and burden Carol Ann Healy, in violation of WV Code §61-2-1, and being against the peace and dignity of the State of West Virginia.
      • Count 3 – Attempted Murder
      • That Noah Richard Tribioli on or about December 2024 in the County of Calhoun, State of West Virginia, committed the crime of Attempted Murder when Noah Richard Tribioli did feloniously and unlawfully slay attempted to willfully, maliciously, deliberately, and unlawfully, slay, kill and murder Steven W. Tribioli but failed to commit or was prevented from committing the felony offense in violation of WV Code §61-11-8(1), a felony against the peace and dignity of the State of West Virginia.
      • Count 4 – Attempted Murder
      • That Noah Richard Tribioli on or about December 2024 in the County of Calhoun, State of West Virginia, committed the crime of Attempted Murder when Noah Richard Tribioli did feloniously and unlawfully slay attempted to willfully, maliciously, deliberately, and unlawfully, slay, kill and murder Claude S. Heagy but failed to commit or was prevented from committing the felony offense in violation of WV Code §61-11-8(1), a felony against the peace and dignity of the State of West Virginia.
      • Count 5 – Malicious Assault
      • That Noah Richard Tribioli on or about December 2024 in the County of Calhoun, State of West Virginia, committed the crime of Malicious Assault when Noah Richard Tribioli did feloniously and maliciously wounded Steven W. Tribioli and caused him bodily injury with the intent to maim, disfigure, disable, or kill the said Steven W. Tribioli, a felony, in violation of WV Code §61-2-9, and begin against the peace and dignity of the State of West Virginia.
      • Count 6 – Malicious Assault
      • That Noah Richard Tribioli on or about December 2024 in the County of Calhoun, State of West Virginia, committed the crime of Malicious Assault when Noah Richard Tribioli did feloniously and maliciously wounded Claude S. Heagy and caused him bodily injury with the intent to maim, disfigure, disable, or kill the said Claude S. Heagy, a felony, in violation of WV Code §61-2-9, and begin against the peace and dignity of the State of West Virginia.
      • Count 7 – Use or presentation of a Firearm During Commission of a Felony
      • That Noah Richard Tribioli on or about December 2024 in the County of Calhoun, State of West Virginia, committed the crime of Use or Presentation of a Firearm during Commission of a Felony when the said Noah Richard Tribioli knowingly and feloniously, while engaged in the commission of the felony crime of Murder as alleged in Count 1 herein, did use or present a firearm, said act being a felony in violation of WV Code §61-7-15a, and being against the peace and dignity of the State of West Virginia.
      • Count 8 – Use or presentation of a Firearm During Commission of a Felony
      • That Noah Richard Tribioli on or about December 2024 in the County of Calhoun, State of West Virginia, committed the crime of Use or Presentation of a Firearm during Commission of a Felony when the said Noah Richard Tribioli knowingly and feloniously, while engaged in the commission of the felony crime of Murder as alleged in Count 2 herein, did use or present a firearm, said act being a felony in violation of WV Code §61-7-15a, and being against the peace and dignity of the State of West Virginia.
      • Count 9 – Use or presentation of a Firearm During Commission of a Felony
      • That Noah Richard Tribioli on or about December 2024 in the County of Calhoun, State of West Virginia, committed the crime of Use or Presentation of a Firearm during Commission of a Felony when the said Noah Richard Tribioli knowingly and feloniously, while engaged in the commission of the felony crimes of Attempted Murder and Malicious Assault as alleged in Counts 3 and 5 herein, did use or present a firearm, said act being a felony in violation of WV Code §61-7-15a, and being against the peace and dignity of the State of West Virginia.
      • Count 10 – Use or presentation of a Firearm During Commission of a Felony
      • That Noah Richard Tribioli on or about December 2024 in the County of Calhoun, State of West Virginia, committed the crime of Use or Presentation of a Firearm during Commission of a Felony when the said Noah Richard Tribioli knowingly and feloniously, while engaged in the commission of the felony crimes of Attempted Murder and Malicious Assault as alleged in Counts 4 and 6 herein, did use or present a firearm, said act being a felony in violation of WV Code §61-7-15a, and being against the peace and dignity of the State of West Virginia.
      • Found upon the testimony of Trooper Levi E. Whitt, WVSP, duly sworn in open Court to testify to the truth and sent before the said Grand Jury to give evidence on this indictment, on the 3rd day of December, 2025.

An indictment does not evidence of guilt but rather evidence of just cause for the case to be tried in a court of law to prove guilt or innocence to the crimes charged. Each defendant is innocent until proven guilty.
