Hardman Arrested for Failure to Appear for Sentencing

Herbert Franklin Hardman, age 48, of Big Bend, West Virginia, plead guilty before Magistrate Richard Postalwait in the Magistrate Court of Calhoun County on December 8th, 2022 to the charges of Driving Suspended DUI 2nd Offense, No Inurance, No Registration and an Expired Motor Vehicle Inspection.

In the original complaint, Cpl. D.C. Moore pulled Hardman over on December 8th, 2022, after he had observed the expired MVI and Registration on Hardman’s vehicle. Once the stop was made Hardman informed Cpl. Moore that his license to drive had been suspended for DUI and that he was not carrying insurance on the vehicle.

On the combined charges Hardman plead guilty understanding the penalties he was facing of 6 months to 1 year imprisonment, $200-$3,000 in fines, $200 to $5,000 in fines and or 15 days to 1 year imprisonment, up to a $500 fine and a $100 fine. He was then told to appear at a later date for sentencing, however he failed to appear and a capias for his arrest was issued.

Arrested on July 27th, 2023, Hardman was taken to the WV Central Regional Jail where he awaits his sentencing hearing. He is currently being held on a $5,000 Surety or Cash bond.
