Judge Ashley sentences Hughes to 1-5 Years

Judge Anita Ashley held Calhoun County Circuit Court on Wednesday, August 2nd, 2023. 

The felony case  of Shannon Marie Brown, 23F10 was scheduled for an October trial date. There is however a discussion regarding a resolution underway between Prosecuting Attorney Nigel Jeffries and Defense Attorney, Michael Cary. 

Calhoun Circuit Court – August 2,  

Forrest Hammer, 23F11, appeared in court by video. His attorney Daniel Minardi had previously waived his hearing to the next term of court. He currently has a September pre-trail set for Thursday, September 7th, 2023 at 10 a.m.

Co Defendants Gelinda Jean Skaggs, 23F13,  and John Eric Hunt, 23F14, 22F30, were scheduled for hearings, but due to the unavailability of Attorney David Richards who was involved in the defense of a murder trial in another county, the cases were continued for August 29th, 2023. 

Candace Cash, 23F5 was sentenced to an indeterminate term of imprisonment for not less than one nor more than three years after her conviction for Unlawful Taking of a Vehicle – Second Offense. 

Jeremey Carl Ferrell was convicted of Domestic Battery in case 23MAP2, Sentencing has been set for October. 

In the matter of State of West Virginia vs. Chadwick Hayden Hughes who is currently incarcerated in the WVCRJ, 21F11, Hughes appeared before Judge Ashley for sentencing on Domestic Battery 3rd Offense with his Attorney, Daniel Minardi. Although Minardi argued on his client’s behalf that he had not had felony priors, nor previously had the opportunity for correction in the Justice system, he should be allowed to work and support his children by receiving probation, Judge Ashley did not agree. She informed Mr. Hughes that because of his previous  absconding and capias for arrest, she did not believe he would be a good candidate for probation.   He was then sentenced to 1-5 years confinement with credit for the 124 days that have been served.
