Plea Entries Entered in Calhoun Circuit Court for January Indictments

In Case 24-F-2, State of WV vs. James Keith Hardman, charged in Count 1 of Failure to Register as a Sexual Offender or Provide Notice of Registration Changes, appeared before Judge Anita Harold Ashley for arraignment. Hardman entered a not guilty plea, his attorney sought discovery from the State and a pretrial date was set for February 15th, 2024 at 10:45 a.m. and a trial date of March 5th at 9 a.m. Hardman’s Attorney, Calvin C. Honaker, Jr. said that he believe the case could be settled early.

James Michael Jones appeared for arraignment in Case 24-F05. Attorney William B. Summers informed Judge Ashley that he would be filing a formal motion for dismissal because the charges of County 1: Possession of a Firearm by a Prohibited  and Wanton Endangerment stemmed from a 2022 case that the State had failed to prosecute. 

Prosecuting Attorney Michael Hicks said that he believed that he and Attorney Summers could work together to submit a joint order in this matter. Judge Ashley set the case for a March 5th review at 9 a.m. and the attorney agreement must be submitted by February 16th.

Ryan Andrew Snider, charged with Manufacturing a Controlled Substance appeared for arraignment in Case 24F1, entering a not guilty plea. Through his Attorney Daniel Minardi, Discovery was sought from the State and Snider waived his right to have a trial in this term of court with a pretrial date being set for April 11, 2024 at 10:15 a.m. and a trial date of June 4th, at 9 a.m. 

Joseph Earl Yoak appeared for arraignment with Attorney Daniel Minardi and entered a plea of not guilty. Attorney Minardi requested a bond reduction that was denied. Minardi argued that the gun in question was muzzle loader and the allegations of not reporting work was for odd jobs, and their was a question as to whether or not he even used the phone that was in the complaint. Prosecuting Attorney Michael Hicks objected stating that these charges had arisen because of “questionable acitivity on Yoak’s internet” causing the task force to show up at his residence. It was then that Judge Ashley refused to lower the bond. A pre-trial date of March 7th, 2024 at 9:30 a.m. and a trial date of March 16th, 2024 at 9:00 a.m were set. 

Codefendants Ryan and Ellio Hardman appeared for arraignment having been charged with Count 1, Child Neglect with Risk of Serious Bodily Injury or Death and County 2, feloniously conspire to commit the crime of Child Neglect with Risk of Serious Bodily Injury or Death. Both defendants pleaded guilty not guilty, discovery was sought by attorneys Daniel Minardi and John J. Balenovich and the case was removed to the next term of Court with a Pretrial set for March 7th, 2024 at 2:30 p.m. and a trial date of April 16th, at 9 a.m.

Mark Christopher Donegan appeared for arraignment in case 24-F-9 charging 3 counts of Wanton Endangerment and 3 counts of Domestic Assault. The defendant  plead not guilty and his Attorney, Daniel Minardi, requested discovery. A not guilty plea was entered and the case was scheduled for a pretrial on April 18th, 2024 at 2:15 p.m. and a trial date of June 4th, at 9 a.m. The defendant waived his right to have his case heard in this term of court. 

In Case 24-F-15, Jonathan Hanley appeared for arraignment entering a not guilty plea to the charge of Count 1: Failure to Register as a Sexual Offender or Provide Notice of Registration. Changes. Attorney Daniel Minardi sought discovery from the state and a pretrial date of February 15th, 2024 at 11:15 a.m. was set with a trial date of March 5th at 9 a.m. 

Isaac Grounds appeared by video for his arraignment in Case 24-F-12 charging Count 1: Driving on a Revoked License for DUI-Third Offense. Grounds is currently a D.O.C. Inmate with an expected release date of October 3rd, 2026. He entered a not guilty plea, and his Attorney John J. Balenovich made a motion for a bond reduction to $10,000. Judge Ashely noted that he would not be eligible for bond until his release from the Department of Corrections but the bond, without State objection was reduced to $10,000. A pretrial date was set for June 6th, 2024 at 10:00 a.m. and a trial date of July 30th, 2024 at 9 a.m.

Kristina Dawn Kirkbridge, Case number 24F-14, Charging Delivery of a Controlled Substance entered a plea of Not guilty. Her next hearing date will be February 15th, 2024 at 1:00 p.m.

Codefendants Jamie Bailey and Jonathan David McIntyre appeared with their Attorneys, Betty C. Gregory and John J. Balenovich to enter their pleas in Cases 24-F-7 and 24-F-8. The pair were charged with Possession of Stolen Property and Conspiracy. Both entered a not guilty plea and their cases were continued for pretrial on June 6, 2024 at 10:30 a.m. and a trial date of August 20th, at 9 a.m. 

Jamie Bailey had a separate case of 24-F-13, that was continued for the same date for pretrial.

The final case of the day was 24F10 and 24F11, involving David Lee Goodrich and Kathy Diane Goodrich, having both been charged with Manufacturing a Controlled Substance. Each defendant with Attorneys Matthew Stonestreet of Giatras Law Firm (David’s Attorney) and Herbert Lively, II (Kathy’s Attorney) entered a plea of not guilty. Discovery was sought from the State by each attorney and the case was continued for pretrial on April 11, 2024 at 11 a.m. and a trial date of July 30th, at 9 a.m.
