Swisher being held for Sexual abuse in the first degree


On April 10th, 2025, at approximately 5:10 p.m., Calhoun County dispatch received a call from a female who stated to dispatch that a male who lived in another apartment at her address had forcibly fondled her breast in her apartment without her consent.

On the same date, at approximately 6:20 p.m. Trooper J.D. Richards arrived on scene and spoke with the victim who stated to him that Allen Swisher had come to her door asking
to borrow some coffee. The victim advised Trooper Richards that she told Mr. Swisher to wait at the door and she would bring him the coffee, but instead of waiting at the door, Mr. Swisher stepped into her apartment and into her
kitchen. She then advised that she handed Mr. Swisher a bag of coffee to which he sat back on the counter. She stated that Mr. Swisher asked if she could keep a secret. Mr. Swisher then asked her to “show him **expletive** multiple times, for which she denied and told him to leave. The Victim further stated that Mr. Swisher grabbed her by the right shoulder keeping her in place and reached up under her shirt and felt her left breast when she had to use force to get him off of her. After this Swisher reportedly left her apartment.

The victim is a small, older woman and cannot ambulate very well.

On the same date, Trooper Richards walked up to Mr. Swisher’s residence and spoke with him inquiring as to what exactly had happened between him and the victim prior to the trooper’s arrival? Mr. Swisher advised that he was sorry. Swisher then advised that he did go to the victim’s apartment for coffee and squeezed her breast. The Trooper inquired if the victim gave consent for him to touch her, for which he responded that he was never given consent, he “just did it.”

On the same date, Trooper Richards placed Mr. Swisher into custody for Sexual Abuse in the First Degree and transported him to the WVSP Grantsville Detachment to be processed and fingerprinted. Allen Cleo Swisher is currently being held at the WV Central Regional Jail being held on a $75,000 bond in case number 25-M07F-00012. All acts occurred in Calhoun County.

§61-8B-7. Sexual abuse in the first degree.
(a) A person is guilty of sexual abuse in the first degree when:
(1) Such person subjects another person to sexual contact without their consent, and the lack of consent results from
forcible compulsion; or
(2) Such person subjects another person to sexual contact who is physically helpless; or
(3) Such person, being fourteen years old or more, subjects another person to sexual contact who is younger than
twelve years old.
(b) Any person who violates the provisions of this section shall be guilty of a felony, and, upon conviction thereof,
hall be imprisoned in a state correctional facility not less than one year nor morgthan five years, or fined not more than $10,000 and imprisoned in a state correctional facility not less than one year nor more than five year
