Citizens work to Remove McCumbers and Postalwait with Petition

Area citizens across the community have determined to remove sitting Commissioner Jacob McCumbers from the his elected position following his arrest on 50 counts of Sexual Abuse by a Parent/Custodian/Person of Trust and Magistrate Richard Postalwait for what they consider incompetence and neglect of duty.

Those behind the petitions will be at the Calhoun County Court House in Grantsville on Saturday (today), September 20, 2025 from 10:00 am to 3:00pm with the petition available for signing. Two separate petitions have been prepared for signing.

Petition # 1:
Registered voters of Calhoun County will have the opportunity to petition the courts for the removal of Calhoun County Commissioner Jacob McCumbers in accordance with West Virginia state law 6-6-7 for:

  1. Gross immorality,
  2. Incompetence, specifically, conduct affecting his ability to perform the essential official duties of his office, and
  3. Neglect of duty
    (Related to charges of 50 felony counts of child abuse of a minor child in the care of parent, guardian or person of trust)

Petition #2:
Registered voters of Calhoun County will have the opportunity to petition the courts for the removal of Calhoun County Magistrate Richard Postalwait in accordance with West Virginia state law 6-6-7 for incompetence and neglect of duty.

  1. Incompetence and/or
  2. Neglect of duty

(Related to the establishment of $100,000 surety bond for McCumbers release and then recusing himself 2 days later).

Three Hundred signatures are needed.
