Cummings Arrested for $11K in Unpaid Child Support

According to an indictment filed in the Circuit Court of Calhoun County in May of 2016, David Scott Cummings, age 37, did unlawfully and feloniously, repeatedly and willfully, fail to pay his court ordered support, which he could reasonably provide and which he knew he had a duty to provide, to a minor by virtue of a court order. The failure resulted in unpaid child support which accrued to an arrearage of $11,717.60. The court had previously ordered the payment of $278.42 per month be paid for the support of two minor children which went unpaid from August 15, 2013.

Following the testimony of Joseph Earnest of the West Virginia Department of Health and Human Resources Bureau for Child Support Enforcement, duly sworn in open court to testify the truth before the Grand Jury, the Grand Jury on the 3rd day of May, 2016 indicted David Scott Cummings.

Cummings was arrested on a Capias on February 26, 2023 for having failed to appear and answer to the indictment in 2016. He is currently being held without bond at the WV Central Regional Jail to await a hearing in the matter as well as being held with a $3,000 bond on Roane County charges for Driving Suspended, No Insurance, Improper Registration and No motor vehicle Inspection.
