Full Day of Circuit Court Cases & Swearing in of Newly Elected Officials for Judge Anita Ashley

Calhoun Circuit Court opened on December 13, 2022 with the swearing in of County Clerk, Jean Simers and Circuit Clerk Sheila Garretson by Judge Anita Harold Ashley. Also sworn in (see story) was Commissioner Craig Arthur later in the morning.

Several cases were continued due to a trial scheduled for Danny Burrows that was expected to take the majority of the day. Those continued were:

  • 22-F-11 State v. Tony McCune appearing with attorney Joel Baker, case continued for Trial on January 31, 2023
  • 22-F-13 State v. Keith Allen Lamp appearing with attorney John J. Balenovich, case continued for February 14, 2023.
  • 22-F-18 State v. Christopher Mark Sampson, defendant did not appear, attorney Betty Gregory advised that he was seeking other counsel, case continued until February 14, 2023 for trial.
  • 22-F-2 State v. Loretta Kay Douglas, defendant moved to Laken Facility, Attorney Calvin C. Honaker Jr. appeared on her behalf, case continued for trial on February 14, 2023.
  •  22-F-5 State v. Thomas Leon Clover, appeared with Attorney Daniel Minardi. Prosecuting Attorney moved to continue case due to having yet receive medical records from Clarksburg Hospital. The Hospital has refused to comply with the request stating that their manner of request did not comply with their record request procedure. Judge Ashley instructed another order be sent to the hospital and they be told an order to show cause would be issued if they failed to comply. Hearing date set for February 14, 2023.
  • 22-B-26 State v. Terry Wesley Peggs appeared by video Microsoft Teams from WV Central Regional jail. Attorney ​Calvin C. Honaker, Jr. requested on the defendant’s behalf for reduction of bond to possibly $5,000 from the current $30,000 to allow the defendant to attend the birth of his child. Prosecuting Attorney Nigel Jeffries argued that because Peggs had committed several serious crimes prior to a felony conviction and the current charge of “Person Prohibited to Possess a Firearm” being an additional felony that his bond be made no lower than $20,000 to $25,000. Judge Ashley lowered his bond to $15,000 which would be 10% or $1,500 cash if paid to a bondsment.
  • 22-B-3 State v. Robby Franklin Lamp, Hearing on State’s Motion to Revoke Bond for Violating Terms of Bail. Lamp appeared with Counsel John J. Balenovich. Bond set at $35,000
