Keener Enters Plea Agreement in Fraud Case

Rebecca Marlene Keener, age 38, entered a plea agreement in the Calhoun Circuit Court before Judge Anita Ashley on Tuesday, December 13th, 2022. Bound over cases 22B15, 16, 17, 18 were dismissed in accordance to her plea agreement for which she agreed to enter a guilty plea to one count of Fraudulent Use of an Access Device (debit card). By entering into the agreement with the State of West Virginia she waived her right to be heard by a grand jury for indictment procedures.

Mrs. Keener confessed to having used the debit card of a McIntyre subject for several purchases on eBay between the months of December 2021 and May 2022. In closing Defense Attorney John Balenovich informed Judge Ashley that he would be asking for probation for his client, but Judge Ashley is under no obligation to accept that recommendation. She will face 1 to 10 years in prison for the crime. Judge Ashley referred the case to Probation Officer Brian Hickman for a pre sentence investigation with a sentencing date of February 2 at 2:30 p.m.
