Deputy C.R. Stephens filed a complaint in Calhoun Magistrate Court stating that on l0/26/26 he was notified by Calhoun Control of a single vehicle crash near Willie’s Red Barn. Upon arrival to the scene he met with Kevin Powers, owner of the crashed truck, who stated he hit a deer and it damaged his truck. Upon looking at the truck Deputy Stephens was unable to locate any evidence of an animal strike, rather damage from metal on metal. Powers and the Deputy walked down the road and were unable to locate any evidence of a deer.

Deputy Stephens was able to determine Powers was traveling south on Route I6 when he exited the roadway across the opposite lane of traffic, striking a culvert ditch and an abandoned old vehicle. In my interactions with Powers he observed the speech of Kevin Powers to be slurred, his gait to be unsteady, the odor of alcoholic beveroges emitting from his person. Powers admitted to consuming alcoholic beverages (despite being under age – 20) but stated he was driving, just trying to take his friend home. Powers submitted to a standardized field sobriety test which he performed poorly. A preliminary breath test was administered with Powers providing a .l 5l BAC. Powers was arrested for DUI and transported to the WVSP detachment for processing. After being read implied consent, Powers provided another breath sample resulting in 0.148 BAC. This crime occurred within the geographical boundaries of Calhoun County, West Virginia.

Jessica Latham posted a property/surety bond in the amount of $1,000. Mr. Powers was released and ordered to return for w pretrial hearing on November 30th, 2026. And defendant is innocent until proven guilty in a court of law.
