In a complaint filed in Calhoun Magistrate Court by the West Virginia State Police, Trooper D.C. Moore, he stated that on Monday, June 10, 2024 in the evening, the accused, Gary Dalton Nicholson said that while he and the 16 year old victim, were out four wheeling in his truck, his truck had gotten stuck.
He further stated that following that event their tempers started to flare and while they were arguing the victim elbowed him in the face. Gary said that he should have walked away but he didn’t and he said that he “blacked out and punched the victim in the face.” He then said that he got her in a choke hold to get her into submission, but the victim then started to scratch him in the face. Gary said he then got out of the truck to get away from the situation.
This incident occurred near the area of Munday Road, known as Munday Beach, in the area of the intersection of Munday Road and Leading Creek Road.
Gary Dalton Nicholson was arrested on the misdemeanor charge of domestic assault and domestic battery and released on a $5,000 bond to await trial.
