
Trooper J.A. Elkins filed a complaint in the Magistrate Court of Calhoun stating that on September 7, 2026 at approximately 11:45 a.m. he was dispatched by Calhoun 911 to 21830 South Calhoun Highway for a single vehicle ATV crash. Upon arrival at the scene Trooper Elkins observed a male, later identified as Robert L. Murphy being uncooperative the Roane County EMS. Immediately upon making contact with Mr. Murphy the Trooper moved him out of the roadway to be further evaluated by the EMS. During that time, Mr. Murphy stated in “excited utterance” that he “Had a lot to drink.”
During the evaluation of Mr. Murphy, Trooper Elkins observed the smell of alcohol. The accused refused to do Standardized Field Sobriety Tests or receive
treatment from EMS and was transported to the Clay WVSP detachment for processing.
Trooper Elkins inquired with the accused whether he would consent to a breathalyzer test to which he agreed. Once the test was administered Mr. Murphy blew a Blood Alcohol Content (BAC) .299.
He was then placed under arrest and charged with the following:
Aggravated DUI. §17C-5-2() and transported to Central Regional Jail in lieu of arraignment. Following a later arraignment his bond was set and posted as a $5,000 property/surety bond. He is set to appear in court for his hearing on October 5th, 2026 at 11:00 a.m. before Magistrate Lora Davis.
