
On August 8th, 2025, Deputy H.M. Stephens filed a complaint in the Magistrate Court of Lora Davis stating that on July 31st, 2025 at approximately 8 p.m. she had received a mental hygiene pick-up order. Upon reading the petition made by the ex-boyfriend of the Robert Marks against the petition, Deputy Stephens observed that Mr. Marks had reported that the respondent cuts her wrists, uses methamphetamine and that he saw fresh cuts on her wrist earlier that day. Upon serving the pickup order on the respondent, Deputy Stephens learned from the respondent that Mr. Marks had recently broken off their relationship and that Mr. Marks had been repeatedly calling, texting and following her all day. The Respondent stated that Mr. Marks had shown up to Deer Run Rentals that day, when she was with a group of friends and began yelling at her and saying that he wanted to talk to her. She also reported that Mr. Marks had used his pickup truck to block
in her friend’s vehicle, preventing the group from leaving.
When Mr. Marks did move the vehicle and the group drove
to Grantsville, they observed that Mr. Marks’ truck was following and tailgating them. The respondent stated that when the group dropped off her friend at her workplace, River Dogz Tavern, Mr. Marks went inside and loudly voiced that
he wanted to speak to the friend. Mr. Marks had to be removed from the tavern by Magistrate Postalwait.
While speaking to the respondent, Deputy Stephens observed that she was lucid and speaking clearly. She did not observe any behaviors typically associated with mental hygiene patients. During the mental hygiene proceedings, the deputy observed the respondent’s arms, which did not bear any signs of cutting or scarring. She was found not certified and was released from custody. After the proceedings, Mr. Marks attempted to speak to the respondent and was prevented by another officer.
Deputy Stephens spoke to the respondent after the proceedings and observed several text messages, voice recordings, and an audio call from Mr. Marks. The text messages from Mr. Marks stated that he “done that because I love you and I want to see you get clean” ” I’m f* sorry for everything I put you f* through I’m so f sorry.” The deputy observed the respondent reply for him to stop contacting her.
After speaking to the respondent and her friends boyfriend, the deputy verified Mr. Marks actions that day and that the respondent had told him to stop trying to talk to her.
The next morning the respondent reported that Mr. Marks had continued to call and text her until 8:00 a.m. on August 1, 2025. The respondent reported that Mr. Marks had continued to call and text her until 3:00 A M on 08/01/2025, after she sent the text for him to stop messaging her. She also expressed to Deputy Stephens that Mr. Marks behavior was causing her stress and she was worried what would happen if he showed up to her house.
On 08/04/2025, Deputy Stephens observed numerous text messages and call logs on the respondents phone from Mr. Marks, despite multiple messages from her, telling him to stop.
In case 25M07M00197, Robert Ashley Marks was arrested and charged with Harassment, Stalking, and Malicious Mischief. He is currently being held in the WV Central Regional Jail with bond set at $8,000 cash only.
