Legal Authority
• West Virginia Open Governmental Proceedings Act – W. Va. Code §6-9A-3 requires that meetings of governing bodies be open to the public, but it does not grant the right to speak without rules. Councils may set reasonable limits on participation.
- Authority to Preserve Order – W. Va. Code $ 8-12-5(23) gives municipalities the power to “preserve order” at meetings and remove disorderty persons.
- Removal of Disruptive Individuals – Courts have held that councils may adopt rules of procedure, and removal is lawful if behavior materially disrupts the conduct of business (consistent with First Amendment limits).
Note: These rules are in place to ensure every voice is heard in a civil and respectful manner, while allowing the Council to conduct the official business of the Town of Grantsville.
