Kim Hudson Pleads Guilty to 3 Counts of Sexual Abuse by Parent, Guardian or Custodian

Kim Allen Hudson, appeared in the Circuit Court of Calhoun county today regarding case 22-B-8 with his attorney Daniel Minardi. Before entering his plea, Judge Anita Harold Ashley questioned the defendant regarding the circumstances of his case coming to trial. Mr. Hudson had previously waived his right to a preliminary hearing, which is the defendants right to have his case heard before a grand jury of 12 juror to determine if his case warrants going to trial. He assured the Judge that he had willfully and knowingly waived his right for that purpose and that he understood in doing so he was giving up his constitutional rights in the matter, agreeing to go forward with felony charges being filed.

With that undertanding clarified the defendant was then charged with 3 counts of sexual abuse by parent guardian or custodian, and based on his waiver the case will be filed under case number 22-F28.

Defendant Kimberly Allen Hudson entered a guilty plea to all three counts, knowing that the penalty for those charges could be: not less than 10 years, nor more than 20 years on each offense, as well as a fine of $500 up t $5,000.00 with up to 50 years of extended supervision. Violation of that supervision could cause confinement of an additional 50 years. He will also have to register as a sex offender upon release from prison.

Judge Ashley dismissed 22B8 and will not pursue any other charges regarding that case.

In addition to Mr. Hudson’s previous statement that he understood fully the consequences of his decision, Judge Ashley further questioned him on his understanding of a guilty plea entered for the offenses changed. That plea would limit his rights to an appeal, but Hudson continued to say that he wanted to proceed in the waiving of his rights and the entering of a plea. Both Hudson and his attorney Minard agreed that Hudson had a clear mind.

Following the reading by Prosecuting Attorney of the charges alleged in the complaint, Judge Ashley agreed that the records established an actual basis for his guilty plea and the plea was accepted by the Judge. The matter will be referred to probation for report and will come back later for sentencing. The case was continued until Thursday, October 6 at 1:30 p.m. for sentencing. Angie Purdue, Probation officer will a do a psychological evaluation prior to sentencing.
