The Calhoun County Commission is committed to being transparent with the public while also protecting the rights of all involved and safeguarding the privacy of minors during the ongoing criminal investigation of Commissioner Jacob McCumbers.
Under West Virginia Code 96-6-7, county officials may be removed from office for causes such as misconduct, neglect of duty, incompetence or on any grounds provided by an applicable statute. The statute outlines several ways this process may begin:
- By a resolution of the County Commission,
- By action of the county prosecutor, or
- By petition of qualified voters.
Once charges are formally brought forward, they must be reviewed by a court. If the petition or resolution meets the legal requirements, the West Virginia Supreme Court of Appeals will appoint a special three-judge panel to hear evidence and determine whether removal from office is warranted. The official has the right to legal representation and to appeal any decision, ensuring due process is followed.
The Calhoun County Commission recognizes the seriousness of the allegations at issue and is carefully reviewing its options under the law. While no final decision has yet been made, the
Commission is committed to moving forward responsibly, keeping the public informed, and respecting the judicial process.
If Commissioner McCumbers were to resign before the legal process is initialed or concludes, West Virginia Code §3-10-7 provides guidance for filling the vacancy. In that case, the Calhoun County Commission would appoint a qualified individual to serve until the next election, thereby ensuring the community remains fully represented.
