
A criminal complaint was requested by Deputy C.R. Stephens on May 7th, 2026 for Donald Smith of 330 Russett Road, Grantsville, WV.
The complaint stated that on 5/4/26 at approximately 10 p.m. Deputy C.R. Stephens responded to a call at 330 Russett Road where the complainant was advising that Donald Smith was yelling and shooting a gun. The dispatcher advised Deputy Stephens that while on the phone she heard a gunshot. Deputy Stephens responded to the scene with Sheriff Graham Knight and approached with caution. Once near the driveway he could see Smith on the back porch and ordered him to come off the porch at gunpoint. After several loud, verbal commands for Smith to come off the porch were given Smith did not comply. Both officers had to approach and physically remove him from the porch where there were firearms. After a search of his person they located two firearms on the porch, a 12 gauge shotgun and a .22 rifle. Strewn throughout the back yard were numerous shotgun and .22 casings. During their interaction, Smith made the statement several times that he was just shooting in the air.
Utilizing a hunting application Deputy Stephens was able to determine that from where Smith was shooting his firearms was within 500 feet of at least 5 dwellings. A later check of Smith’s criminal history shows convictions for domestic violence in Calhoun Magistrate Court in 2011 ( Case #s 11-M07M-00145 and 11-M07M-00123.
Smith was charged with 2 counts of possession of a firearm by prohibited person, one count of shooting within 500 feet of a dwelling and 1 count of obstruction. He is being held, awaiting trial, on a $10,000 bond in the WV Central Regional Jail. A bond modification hearing is scheduled for June 9th, 2026 at 9:00 a.m.
