Notice: Town of Grantsville – Public Comment Rules:
- Town Council welcomes public participation. In order to maintain a respectful and orderly meeting, the following rules apply during the Public Comment period:
- Time Limit: Each speaker will be given (5 minutes] to address the Council.
- Relevance: Comments must relate directly to town business or the posted agenda.
- Respect: Personal attacks, defamatory remarks, shouting, or disruptive behavior is not allowed/
- Decorum: All comments must be directed to the Council as a whole, not to individuals, staff or audience members.
- No Debate: The Council will listen but may not engage in back-and-forth discussion during public comments.
- Enforcement: The Mayor or presiding officer may call a speaker out of order or end a speaker’s time if rules are violated.
- Any person who disrupts the meeting may be removed from the meeting room.
* Legal Authority
- West Virginia Open Governmental Proceedings Act – W. Va. Code § 6-9A-3 requires that meetings of governing bodies be open to the public, but it does not grant the right to speak without rules. Councils may set reasonable limits on participation.
- Authority to Preserve Order – W. Va. Code § 8-12-5(23) gives municipalities the power to “preserve order” at meetings and remove disorderly persons.
- Removal of Disruptive Individuals -Courts have held that councils may adopt rules of procedure, and removal is lawful if behavior materially disrupts the conduct of business (consistent with First Amendment limits).
- Note: These rules are in place to ensure every voice is heard in a civil and respectful manner, while allowing the Council to conduct the official business of the Town of Grantsville.
