
In a complaint filed in the Magistrate Court of Calhoun County, on On Friday, August 1st, 2025, Sr. Trooper J. Richards reported that a stop was made at 1:20 a.m. while conducting a routine road patrol on WV Route 16. In the 3,000 block of South Calhoun Highway, Trooper Richards observed a Maroon 2005 Chevrolet Silverado traveling South go over the ridge side fog line before cross the double yellow line with all four tires in the opposing lane while rounding a left-hand obstructed curve. A traffic stop was initiated with the vehicle at 4817 South Calhoun Highway where Trooper Richards made contact with the driver Dana Alan Wease Il.
Trooper Richards observed the odor of alcoholic beverage
emitting from the Mr. Wease as he spoke. He then asked the driver for his documents where he only received a copy of his
driver’s license and had to remind the driver that he had asked for vehicle registration and insurance as well.
Trooper Richards observed slowed-slurred speech from Mr. Wease along with flushed face, general confusion, fumbling
with documents and blood-shot watery eyes. The Trooper instructed Mr. Wease to step out of the vehicle to conduct the Standardized Field Sobriety Tests. Mr. Wease advised
that he had drank four (4) beers back-to-back before driving. At the conclusion of these tests, Trooper Richards determined that Mr. Wease was impaired.
Dana A. Wease II was placed into custody for Aggravated DUI and left of center and transported to the WVSP Grantsville Detachment for a Secondary Chemical Test of Breath. At 2:38 a.m. the test determined that Mr. Wease’s BrAC was 0.1.57.
Wease has been released from Jail.

§17C-7-6. Same — Further limitations on driving to left of center of roadway; penalty.
(a) No vehicle shall at any time he driven to the left side of the roadway under the following conditions:
(1) When approaching the crest of a grade or upon a curve in the highway where the driver’s view is obstructed
within such distance as to create a hazard in the event another vehicle might approach from the opposite direction.
§17C-5-2. Driving under influence of alcohol
(1) Any person who drives a vehicle on any public highway or private road in this state while he or she has an alcohol
concentration in his or her blood of fifteen hundredths of one percent or more, by weight, is guilty of a misdemeanor
and, upon conviction thereof, shall be confined in jail for not lexs than two days nor more than six months, which jail
term is to include actual confinement of not less than 24 hours, and shall be fined not less than $200 nor more than
$1,000, and shall have his or her license to operate a motor vehicle revoked by the Commissioner of the Division of
Motor Vehicles for a period of one vear or for a period of time conditioned on participation in the lest and lock
program in accordance with 17C-5A-3a of this code. A person sentenced pursuant to this subsection shall receive
credit for any period of actual confinemem he or she served upon arrest for the subject offense.
